CHANGE ORDER #3 <br />(Attachment) <br />This contract is amended as follows: <br />WHEREAS: It was determined that the storm sewer would be in conflict with the existing 16" <br />watermain along Little Canada Road and would not allow for structure <br />placement; and <br />WHEREAS: The Engineer determined that the watermain would need to be offset and the <br />work done on a Saturday because a daycare facility would be out of water while <br />the work was being done; and <br />WHEREAS: It was determined that irrigation repairs were necessary due to the impacts of the <br />street work and that the Contractor would be responsible for those repairs and be <br />reimbursed 50% of those costs; and <br />WHEREAS: The original bid items did not include bituminous curb and the Engineer <br />determined that it should be used where no existing concrete curb existed to tie <br />into; and <br />WHEREAS: The Contractor was directed to install bituminous curb on the north bound <br />Edgerton turn lane; and <br />WHEREAS: It was determined that the delays caused by private utility companies would not <br />allow for completion of the project in 2013 and the Contractor should provide <br />temporary ramping of iron and at the Edgerton turn lane as well as temporary <br />seed all areas to be sodded; and <br />WHEREAS: It was anticipated that all reclaim material would be used on -site for street <br />corrections and as base material under the sidewalk and driveways, and <br />WHEREAS: Excess reclaim material was generated on site and had to be hauled off, and <br />WHEREAS: The Engineer directed the Contractor to complete the work on a time and <br />material basis as part of this project. <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT: <br />1. The Contractor shall complete the above described changes and additions to the project. <br />2. Payment for the work was reviewed and approved by the Engineer. <br />3. The Contractor will not make claim of any kind or character for any other costs or <br />expenses that he may have incurred or that he may hereafter incur in performing the <br />work or furnishing the materials of this agreement. <br />GENERAL CONDITIONS 00700 - 2 <br />6 <br />
