MINUTES <br />PLANNING COMMISSION <br />MARCH 13, 2014 <br />AMEND <br />ZONING CODE <br />RELATIVE <br />TO DEFINITION <br />Barraclough asked the downside of rezoning the property to I -1 District <br />and if there would be a precedent in doing so. The City Planner indicated <br />that the City has the greatest amount of discretion when making zoning <br />changes, and that there would be no precedent. The Planner noted that the <br />issue with a rezoning is that it opens the property up to all uses allowed <br />within the particular zoning district. With regard to I -1 Zoning, the <br />Planner noted that the site would then be opened to auto - related uses. The <br />Planner pointed out that the City has no limitation on the number of auto <br />repair licenses, although a CUP would be required to obtain an auto repair <br />licenses. <br />Schwalbach asked if the City could deny the rezoning because it did not <br />want outdoor storage expanded on this site. The Planner replied that that <br />was sufficient reason to deny the rezoning. The Planner commented that <br />denying the rezoning so that the property is not opened up to auto - related <br />uses is also legitimate reason. <br />Schwalbach pointed out that in both cases, outdoor storage and auto - <br />related uses, CUP applications would have to he submitted for review and <br />approval. <br />Schwalbach recommended approval of the Rezoning of 3065 Spruce <br />Street from Industrial -Park (I -P) District to Light Industrial (I -1) District <br />based on the criteria outlined in the City Planner's March 3, 2014 report. <br />Motion seconded by Murphy. <br />Motion carried 5 — 1. Fischer voted against. <br />Fischer stated that he voted against the rezoning as opening the property to <br />auto - related uses was very concerning. I -Ie also noted the original purpose <br />of rezoning this property to I -P District was to reduce the amount of <br />outdoor storage in the area. <br />Stockness reported that he receives calls weekly from people wanting to <br />lease space for auto - related uses. Stockness reported that he has left <br />spaces vacant rather than rent to users that would negatively impact <br />existing tenants. <br />The City Planner presented the Commission with an amendment to <br />the Zoning Code which deletes a reference to Chapter 4 of the City <br />Code in the definition of "Family ". The Planner noted that this <br />reference is in error and the City does not have a Chapter 4. The Planner <br />7 <br />
