Hanson <br />The City's Tobacco Ordinance currently has a maximum of ten Tobacco Licenses. While the <br />Ordinance provides for two categories of licenses — Tobacco Store License and "Tobacco General <br />Sales & Display License — the maximum number of licenses is not linked by category. Currently <br />the City has eight General Sales & Display Licenses and two "Tobacco Store Licenses. <br />A recent news report indicated that CVS Pharmacy has made a corporate decision to no longer <br />sell tobacco products. Based on that, I anticipate that the City will have one Tobacco License <br />available during the next renewal year — July 1, 2014 through June 30, 2015. <br />The City receives frequent inquiries about the availability of Tobacco Licenses from individuals <br />interested in opening tobacco stores (both with and without sampling). Given there are no <br />licenses available at this time, the callers are informed of this situation, With the pending <br />availability of a license, that will no longer he the case. While this may or may not be a concern <br />for the Council, 1 wanted to be proactive in pointing out this matter. There appears to be three <br />options that the Council could consider. The first would be to take no action and retain the <br />current maximum of ten Tobacco Licenses with no maximum tied to license category. The <br />second would be to decrease the number of Tobacco Licenses to nine effective July 1, 2014. The <br />third would be to create categories of Tobacco Licenses setting a maximum number per <br />category, i.e. eight General Sales & Display Licenses and two Tobacco Store Licenses. <br />If the Council feels that a change is needed, action should be taken to amend the Municipal Code <br />relative to the "Tobacco Ordinance. <br />1 <br />
