MINUTES <br />CITY COUNCIL <br />APRIL 23, 2014 <br />Blesener asked about the potential for interference with redevelopment of <br />this area. The City Administrator reported that the City Engineer has <br />reviewed this issue, and has determined that the proposed location is the <br />best one to minimize impact on redevelopment. He noted that Verizon is <br />requesting access easements through the site, and indicated that the access <br />issue will be addressed with Verizon to minimize the impact on <br />redevelopment. The Administrator pointed out that when the site <br />redevelops, the City will have to address the two tower locations, possibly <br />amending the Code to allow the tower sites to he split off allowing cell <br />towers as a principal use on a site. <br />The City Administrator pointed out that as part of the application, Verizon <br />did not provide a fall zone study or an engineering frequency analysis. <br />Again, the issue of access to the cell tower location will have to he worked <br />out with Verizon so that the City has flexibility in the redevelopment of <br />the area while providing Verizon with access to the tower site. The <br />Administrator also noted that the cell tower lease will also have to be <br />negotiated with Verizon, and noted that the lease compensation proposed <br />by Verizon is not adequate. The Administrator pointed out that the <br />outstanding issues can be addressed as part of the building permit process <br />and finalization of the lease agreement. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by McGraw, seconded by Keis, the public hearing was <br />closed. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014 -4 -73 — APPROVING A CONDITIONAL USE <br />PERMIT FOR CONSTRUCTION AND OPERATION OF A CELL <br />TOWER AT 53 SOUTH OWASSO BLVD., VERIZON WIRELESS, <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS <br />OF THE CITY PLANNER AS OUTLINED IN HIS APRIL 4, 2019 <br />REPORT, SUBJECT TO SUBMISSION OF ALL REQUIRED <br />DOCUMENTS, INCLUDING BUT NOT LIMITED TO FALL ZONE <br />REPORT, ENGINEERING FREQUENCY ANALYSIS, ETC., AND <br />SUBJECT TO FINALIZATION OF THE CELL TOWER LEASE <br />AGREEMENT WITH THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (3). <br />Nays (0).
