3. The operation of the facility includes measures which keep vehicles from
spreading mud, dirt, dust, or debris off of the site onto adjacent public roadways.
4. The operation of the facility includes measures for controlling the creation of dust
and other particulate matter through watering of the materials, or other methods.
5. Other conditions or requirements as specified by the City Council deemed
necessary to keep the site from becoming a nuisance to the public or to adjoining
property owners.
6. The aggregate materials stockpiling and/or recycling operation must be the
exclusive use of the property subject to the permit, and shall not be mixed with
other land uses, whether permitted or conditional.
7. The applicant/operator of the facility posts a financial security guaranteeing
compliance with the conditions listed in the permit approval.
8. The applicant/operator of the facility executes an interim use development
agreement specifying the conditions of approval, the amount and form of the
security to be posted, and the termination date of the interim use.
9. The applicant provides a restoration plan, with an appropriate financial security, to
return the site to a clean, vegetation -covered state upon termination of the project.
With these requirements, the City would have the ability to manage the effects and
impacts of the use, with only limited the potential for the use to projects that are
relatively rare, but important to be able to facilitate in the area.
Summary and Recommendation
The proposed amendment is intended to allow, but limit, the potential construction
activity under this permit to public projects, and allow this use on otherwise vacant land
to avoid conflicts with permanent industrial land uses. The applicant would have some
additional requirements to meet to ensure compliance with the terms of the code as
written, primarily related to stormwater management and securities for compliance.
Under these terms, staff would be able to support the amendment and IUP as
requested.
pc: Kathy Glanzer
Steve Westerhaus
Lee Elfering
Joe Miessen, PCI Roads, 14123 42nd St. NE, St. Michael, MN 55376
