The applicant indicates that they will haul and stockpile materials for making concrete <br />on the site, set up the temporary batch plant, and load concrete mixing trucks with fresh <br />concrete which will be hauled to the project. The applicant proposes to use the site <br />from August of 2014 through September of 2015. The haul route would be from the <br />freeway at Little Canada Road to the site access locations on South Owasso Boulevard <br />via Country Drive. <br />The City has eliminated these uses from the zoning ordinance over the past several <br />years, providing only for the stockpiling use on the Fra -Dor property under a separate <br />zoning district and interim use permit. The terms of the IUP in the 1-2 District are as <br />follows: <br />A. Aggregate Materials Stockpiling and/or Recycling, subject to the following <br />conditions: <br />1. The use is found to be consistent with the existing land uses in the area and with <br />the underlying land use plan for the district in which it is located. <br />2. The use is screened with earth berms and landscaping from the adjacent streets to <br />a minimum height of ten feet. <br />3. The operation of the facility includes measures which keep vehicles from <br />spreading mud, dirt, dust, or debris off of the site onto adjacent public roadways. <br />4. The operation of the facility includes measures for controlling the creation of dust <br />and other particulate matter through watering of the materials, or other methods. <br />5. Other conditions or requirements as specified by the City Council deemed <br />necessary to keep the site from becoming a nuisance to the public or to adjoining <br />property owners. <br />6. The aggregate materials stockpiling and/or recycling operation must be the <br />exclusive use of the property subject to the permit, and shall not be mixed with <br />other land uses, whether permitted or conditional. <br />7. The applicant/operator of the facility posts a financial security guaranteeing <br />compliance with the conditions listed in the permit approval. <br />8. The applicant/operator of the facility executes an interim use development <br />agreement specifying the conditions of approval, the amount and form of the <br />security to be posted, and the termination date of the interim use. <br />If an amendment is to be considered, the applicable sections of this code would be <br />appropriate. Item 2 is likely not applicable to the request at hand, give the short-term <br />nature of the project. However, it would be valuable to consider a restoration <br />requirement, since upon termination of the use, the site would otherwise create a <br />likelihood of stormwater and erosion issues. Using these requirements as a model, the <br />City could consider an amendment such as follows: <br />A. Temporary Concrete Mixing Plat and accessory Aggregate Materials Stockpiling <br />and/or Recycling, subject to the following conditions: <br />1. The use is found to be consistent with the existing land uses in the area and with <br />the underlying land use plan for the district in which it is located. <br />2. The use is related to a public infrastructure construction project of limited <br />duration. <br />
