MINUTES <br />PLANNING COMMISSION <br />JUNE 12, 2014 <br />Planner noted that when a home occupation has employees, the issue of <br />the unfair competition with businesses in commercial districts is triggered. <br />Malietzke asked about home day cares that typically have employees. The <br />City Planner reported that home day cares are allowed under State Law <br />and the City does not have regulatory authority. Malietzke noted that it is <br />unfortunate that the SUP is triggered by the part-time employee, noting <br />that when Lindberg and her husband operated the business, they could do <br />so without a SUP. <br />Fischer indicated that in considering the information presented this <br />evening, he believes that there are special conditions that would allow the <br />SUP to be granted. He also noted that the Code provides for a one year <br />review of the SUP and 3 year reviews subsequent. <br />Duray asked if there are any other SUPs of this nature that have been <br />issued. The City Planner indicated that a number of years ago an SUP was <br />issued to a doctor who had a part-time employee doing some work from <br />her home. The Planner indicated that it was his belief that the SUP was no <br />longer active. <br />Duray asked if Lindberg had considered opening a small office, noting <br />there are several vacancies in the City. Lindberg replied that she did not <br />want to grow the business, which would be required in order to pay the <br />overhead costs. Fischer asked if the part-time employee could work from <br />his/her home rather than Lindberg's. Lindberg indicated that this would <br />not be practical given the need to interact with one another on the work <br />that is being done. <br />William Zopfi, 2309 Stephanie Court, reported that he has been a neighbor <br />for the past 15 years as well as secretary of the association board. Zopfi <br />reported that no formal complaints have been filed about Lindberg's <br />business. <br />Larry Gaalaas, 2290 Stephanie Court, reported he had no objections to the <br />home occupation. <br />Ledin asked if special conditions that would allow issuance of the SUP <br />would have to be unique to the business or the property. The City Planner <br />indicated that the special circumstances could be unique to either. <br />Murphy recommended approval of the Special Use Permit for home <br />occupation for a home office with a part-time employee at 2310 Stephani <br />Court, Heather Lindberg, given that it is the position of the Planning <br />-4- <br />
