Hanson <br />Staff has been meeting with Mr. Frattalone regarding the Interim Use Permit Agreement <br />we reviewed about five years ago. While we had agreed on the key terms, the agreement <br />itself was not presented to Mr. Frattalone for execution due to concerns I had about the <br />way the final document was being drafted. While the agreement was not executed, Mr. <br />Frattalone has been complying with its terms on the agreed upon schedule. <br />Earlier this year, the Patrick Kelly of the City Attorney's Office was able to resolve the <br />drafting concern issue in a manner favorable to the City's perspective. Since then, I have <br />been reviewing the agreement with Mr. Frattalone and the final document is nearing <br />completion. However, we are now coming up on the five year term and an extension is <br />being requested. Rather than finalize an agreement that is about to expire, the City <br />Attorney's office is recommending we put a new document in place dealing with the <br />extension. I need to emphasize that technically, the request to extend should have been <br />dealt with one year prior to expiration. However, the delay in addressing this is not from <br />the lack of effort on Mr. Frattalone's part. Rather, the City's delay in getting the initial <br />agreement in final form is the cause of the delay. <br />Therefore, staff is recommending we call for a workshop to review the current agreement <br />and discuss the provisions for an extension. Mr. Frattalone has indicated he is available <br />on either July 9t' or 23"I. I would recommend we call for this workshop on one of those <br />dates with the final decision dependent on the Fire Department's decision for a possible <br />workshop on those same dates. I hope to have their decision by Wednesday's meeting so <br />we can choose the remaining date to meet with Mr. Frattalone. Regardless of the date, <br />staff would recommend a 6:00 starting time. <br />cc: Frank Frattalone <br />
