MINUTES CITY COUNCIL APRIL 25, 2007 Montour stated that he can appreciate the arrangement, but questioned the ability of The Venetian to serve alcohol at the Oops Theater. It was noted that The Venetian holds both an On-Sale Liquor License as well as a Catering License. There was no one else present from the general public wishing to comment on this matter. Upon motion by Allan, seconded by McGraw, the public hearing was closed. Allan introduced the following resolution and moved its adoption: RESOL UTION NO. 2007-4-99 - APPROVING A PLANNED UNIT DEVELOPMENT PERMIT TO ALLOW THE OPERATION OFA DINNER THEATER/BANQUET FACILITYAT THE MARKET PLACE SHOPPING CENTER AT 2900 RICE STREET AS REQUESTED BY THE OOPS THEATER SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER The foregoing resolution was duly seconded by Blesener. Ayes (4). Nays (0). Resolution declared adopted. CUPS, TEXT Mayor Blesener opened the continuation of Public Hearing to consider AMENDMENT, the applications of Valor Enterprises located at 3161-3167 Spruce Street AND LICENSES - for the following: 3161-3167 Conditional Use Permit for motor vehicle sales lot; SPRUCE STREET - Conditional Use Permit for outdoor storage of motor vehicles VALOR (for sale and repairables) and storage containers; ENTERPRISES Text Amendment to the City Code increasing the maximum number of motor vehicles sales lot licenses (indoor) from four (4) to five (5); Motor Vehicle Repair License; Motor Vehicle Sales Lot (Outdoor) License; Motor Vehicle Sales Lot (Indoor) License. The City Planner began with a detailed review of his April 12, 2007 report first outlining the specific standards in the Zoning Ordinance for review of Conditional Use Permits and Text Amendments. The Planner provided detailed comments in this report relative to the following standards: 1. Comprehensive Plan Consistency; 2. Compatibility with present and future land uses; 3.
