MINUTES <br />CITY COUNCIL <br />APRIL 25, 2007 <br />With regard to the electrical work that the City claims in its Apri125, 2007 <br />report without a permit, Griffith reported that King Electric applied for an <br />electrical permit on-line and was informed that since there are two <br />addresses for the Valor property, two permits would be required. <br />Griffith reported that he has photos of other properties in Ryan Industrial <br />Park that show similar issues as exist on the Valor property, i.e. storage, <br />paving, etc. <br />Griffith noted that the City Planner's January 5, 2007 report indicates that <br />the Valor property substantially complies with the conditions set out in the <br />I-1 District for issuance of a CUP for both auto retail sales and outdoor <br />sales. The City Planner noted that in instances where there is not full <br />compliance with the conditions for issuance of a CUP, most cities will <br />condition issuance upon satisfaction with reasonable conditions. <br />Griffith then reviewed in detail his April 25, 2007 report outlining the <br />property's substantial compliance with conditions for the issuance of the <br />CUP based on the City Planner's findings dated January 5, 2007. Areas <br />covered were the Retail Auto Sales CUP and the Open and Outdoor <br />Storage CUP. Griffith then noted that his report outlines the discussion of <br />applicable law. <br />Griffith indicated that, in conclusion, whether you agree or not, Valor <br />Enterprises has spent months and many dollars, while the business has <br />been closed, to get this property into compliance. Valor Enterprises has <br />reduced the number of violations by half. Griffith stated that if the City <br />wants to deny the CUPS as a penalty for code enforcement, the City can do <br />that, but he does not think it will be upheld in court. <br />Griffith reported that Valor Enterprises will bring the property into <br />compliance and satisfy the fairly modest conditions that would be required <br />to do so. To not issue the CUPs and licenses would results in total loss of <br />value of the property. <br />Griffith noted that the property is for sale, and it will be very difficult to <br />sell this property without outdoor storage. He noted that almost every <br />property in Ryan Industrial Park has outdoor storage. Griffith felt it <br />unreasonable to say that the building can be used for auto repair, but no <br />outdoor storage would be allowed in conjunction with that use. Griffith <br />also noted the Valor application for a Text Amendment to add a fifth <br />vehicle sales lot, noting the past history of five lots in the City. Griffith <br />reported that they are seeking the Council's approval for the CUP's, Text <br />Amendment, Vehicle Repair License, and Vehicle Sales Lot License. <br />18 <br />
