MINUTES <br />CITY COUNCIL <br />APRIL 25, 2007 <br />20. Based on observances by City Staff as documented in the code <br />enforcement officer's report dated Apri125, 2007, Valor has continued to <br />repair vehicles without the required Motor Vehicle Repair License <br />(Municipal Code Chapter 803) since non-renewal on September 27, 2006. <br />21. Based on documentation provided by the Minnesota Department of <br />Motor Vehicle Licensing, Valor Enterprises does not possess a retail or <br />wholesale dealer's license at this time. <br />22. Based on Little Canada Municipal Code Chapter 803 entitled Used <br />Car Sales, the applicant has continually demonstrated his inability to <br />comply with provisions related to "Operation Location" and <br />"Responsibility of Operation". <br />23. Based on Little Canada Municipal Code Chapter 807 entitled <br />Motor vehicle Repair, the applicant has continually demonstrated his <br />inability to comply with provisions related to "Premises Neat and <br />Orderly" and "Parking of vehicles" as provided for in 807.060. <br />24. Little Canada inspection personnel prepared an Electrical <br />Inspection Report, dated January 26, 2007, a Fire Inspection Report, dated <br />February 2, 2007, and a Building Inspection Report, dated February 5, <br />2007. These reports enumerate the conditions existing on the Property as <br />of the date of the reports. On April 24, 2007, the Property was inspected <br />by inspection personnel to update the earlier reports and to ascertain the <br />current condition of the Property. The inspection of the Property <br />indicated that numerous violations of various code provisions still exist as <br />of April 24, 2007, as follows: (1) violations of the National Electrical <br />Code Articles 300, 500-504, 516, 210, and 110; (2) violations of the <br />Minnesota State Fire Code Sections 605.1, 605.3, 605.3.1, 605.4, 605.4.1, <br />605.6, 605.9.1, 304.1, 304.2, 304.3.1, 315.1, 315.2.3, 315.2.4, 315.3.1 <br />906.7, 603.5, 603.5.1, 603.5.2, 603.7, 703.1, and 703.2; (3) violations of <br />the Minnesota State Building Code Sections 1300.0120, 1311.0411, and <br />1341.0411; (4) violations of International Building Code Sections <br />302.3.3, 1503, 1003.2.10, 1003.2.11, 1003.2.12, 1003.3.1.4, 1003.3.3, <br />1003.3.3.2, 1003.3.3.4, Table 1607.1, 10033.3.11; (5) violations of the <br />Minnesota Mechanical Code Sections 1346.0404, and 1346.501.3; and (6) <br />violations of Minnesota Plumbing Code Sections 4715.2110 and <br />715.0900. These facts are additional reasons for the denial of the <br />conditional use permit for motor vehicle sales lot, the conditional use <br />permit for outdoor storage, the text amendment increasing the number of <br />motor vehicle sales lot licenses, the application for a motor vehicle repair <br />license, the application for a license for a motor vehicle sales lot and the <br />application for a used car sales license. <br />22 <br />
