MINUTES <br />CITY COUNCIL <br />APRIL 25, 2007 <br />The City Administrator indicated that at the Planning Commission <br />meeting it was alleged that the City has discouraged potential buyers from <br />purchasing the Valor property. The Administrator noted that the City has <br />only provided factual information to people making inquiries about the <br />property. He also noted that the City currently has a moratorium in place <br />on the issuance of CUPs for outdoor storage in the I-1 Zoning District. <br />The Administrator noted that the Council held a workshop on outdoor <br />storage prior to this evening's Council meeting, and he had invited the <br />realtor listing the Valor property to this workshop. The Administrator <br />indicated that if people request copies of the reports on the Valor property, <br />the City is obligated to provide that public information. <br />The City Attorney reported that Minnesota State Law requires that the <br />Council either grant, deny, or any combination thereof, the applications <br />before it this evening. If the Council denies, the City Attorney reported <br />that State law requires Findings of Fact for the denial, and that these <br />findings be presented to the applicant in writing. The City Attorney noted <br />that Findings of Fact prepared and read into the record this evening by the <br />City Planner. The City Attorney noted the Public Hearing this evening for <br />the following zoning actions: <br />Conditional Use Permit for motor vehicle sales lot; <br />Conditional Use Permit for outdoor storage of motor vehicles <br />(for sale and repairables) and storage containers; <br />Text Amendment to the City Code increasing the maximum <br />number of motor vehicles sales lot licenses (indoor) <br />from four (4) to five (5). <br />The City Attorney noted the three license applications before the Council <br />this evening: <br />Motor Vehicle Repair License; <br />Motor Vehicle Sales Lot (Outdoor) License; <br />Motor Vehicle Sales Lot (Indoor) License. <br />There was no one else present this evening wishing to comment on these <br />matters. <br />Upon motion by Allan, seconded by McGraw, the public hearings were <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2007-4-100 -DENYING THE APPLICATION OF <br />VALOR ENTERPRISES, 3161-3167 SPRUCE STREET, FOR <br />CONDITIONAL USE PERMIT FOR MOTOR VEHICLE SALES LOT <br />BASED ON THE TWENTY-FOUR (24) FINDINGS OF FACT AS <br />23 <br />
