From: peggyb52@hotmail.com <br />To: council@ci.little-canada.mn.us <br />Subject: Special Use Permit - 2310 Stephani Court <br />Date: Fri, 20 Jun 2014 15:55:56 -0500 <br />TO: City of Little Canada City Council <br />Bill Blesener, Mayor <br />Shelly Boss <br />Michael McGraw <br />John Keis <br />Rick Montour <br />SUBJECT: 2310 Stephani Court - Special Use Permit - Cobblestone Village Association (CVA) Townhomes <br />In light of the recent request for a special use permit at 2310 Stephani Court, and the Planning Commission's <br />recommendation for that request, there are members of the Cobblestone Village Townhome Association who <br />would like to provide additional information to the Council for consideration in determining the decision for <br />the permit. We posed a request to the CVA Board to address the issue with CVA members and the City, but <br />their preference is to postpone their action until the City Council makes their decision. <br />CVA's governing Declaration states the following: <br />"No business, trade, occupation or profession of any kind, whether carried on for profit or otherwise, shall be <br />conducted, maintained or permitted on any Lot, except: (i) an Owner or occupant residing in a Lot may keep <br />and maintain his or her business or professional records in such Lot and handle matters relating thereto by <br />telephone or correspondence therefrom, provided that such uses are incidental to the residential use of the <br />Lot; and (H) the Association may maintain offices on the Property for management and related purposes." <br />The business conducted at 2310 has been performed for a number of years. The issue is the permit would <br />allow for employee(s). As you are likely aware, CVA maintains its own property, which is private and clearly <br />marked at its entrance. There are members who do not want business (employee or client) activity on our <br />property. And, the Declaration governing reference is a major component on why we reside at Cobblestone. <br />If the City Council rules in favor of the permit, it will cause concern for the safety of our members and <br />potential for future allowances for home business activity in our community. I am submitting this information <br />on behalf of 9 CVA townhome owners who have voiced their concerns regarding this request. We do not want <br />this. Your consideration of these concerns is appreciated in making the decision on whether to approve the <br />2310 special use permit. <br />
