The parties agree and acknowledge that Owner remains the owner in fee simple of <br />the Property subject to this Agreement, and that the City does not acquire a possessory interest in <br />the Property by virtue of this Agreement or any permit or other instrument required by the <br />permitted stockpiling and recycling operation. <br />11. Owner hereby grants City, its agents and employees, a license to enter any of the <br />Property to perform all necessary work, maintenance and/or inspections deemed appropriate by <br />the City during operation and associated with the restoration of the Property. The license shall <br />expire after the cessation of activities pursuant to the Interim Use Agreement. <br />12. The Owner remains responsible for the environmental condition of the Property. <br />The City shall not have any responsibility or obligation to undertake any clean-up or remediation <br />for environmental pollution on the Property. <br />Additional Documents <br />13. Prior to the execution of this Agreement, Owner has submitted, and the City has <br />approved, design drawings and schematic plans. The items referenced, whether submitted with <br />Owner's 2008 application or in previously submitted and approved in connection with prior <br />agreements with the City, are hereby incorporated by reference in this Agreement. Owner shall <br />act in conformity with those plans and specifications unless deviations are specifically approved <br />by the City Council, <br />Permitted Activity <br />14. Subject to compliance with the terns of this Agreement, the Owner shall be <br />permitted to operate storage, stockpiling, and processing (crushing) of aggregate materials and <br />6 <br />
