The parties agree and acknowledge that Owner remains the owner in fee simple of the Property subject to this Agreement, and that the City does not acquire a possessory interest in the Property by virtue of this Agreement or any permit or other instrument required by the permitted stockpiling and recycling operation. 11. Owner hereby grants City, its agents and employees, a license to enter any of the Property to perform all necessary work, maintenance and/or inspections deemed appropriate by the City during operation and associated with the restoration of the Property. The license shall expire after the cessation of activities pursuant to the Interim Use Agreement. 12. The Owner remains responsible for the environmental condition of the Property. The City shall not have any responsibility or obligation to undertake any clean-up or remediation for environmental pollution on the Property. Additional Documents 13. Prior to the execution of this Agreement, Owner has submitted, and the City has approved, design drawings and schematic plans. The items referenced, whether submitted with Owner's 2008 application or in previously submitted and approved in connection with prior agreements with the City, are hereby incorporated by reference in this Agreement. Owner shall act in conformity with those plans and specifications unless deviations are specifically approved by the City Council, Permitted Activity 14.
