MINUTES <br />CITY COUNCIL <br />JULY 23, 2014 <br />PROPERTY <br />DIVISION & <br />VARIANCE — <br />CENTERVILLE <br />ROAD — <br />PETERS <br />Upon motion by Keis, seconded by Boss, the public hearing was closed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-7-135 — APPROVING A VARIANCE FOR <br />SIGN SETBACK TO ALLOW PLACEMENT OFA MONUMENT <br />SIGN ON THE PROPERTY LINE FOR 219-223 LITTLE CANADA <br />ROAD, MAYHEM PROPERTIES, SUBJECT TO THE FINDINGS AS <br />OUTLINED IN THE CITY PLANNER'S REPORT DATED JULY 3, <br />2014 AND SUBJECT TO THE RECOMMENDATIONS OF THE CITY <br />PLANNER AND THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Montour opened the Public Hearing to consider approval of a Property <br />Division for relocation of a property line and a Variance from lot width <br />requirements for property located at 3000 and 3020 Centerville Road <br />owned by Joe Peters. Both the City Planner and the Planning Commission <br />recommended approval of the Property Division and Variance. <br />The City Planner reviewed his report dated July 3, 2014 relative to the <br />request to move a property line by 10 feet and a Variance from lot width <br />requirements. The Planner noted that Mr. Peters owns both lots at 3000 <br />and 3020 Centerville Road, and is proposing to construct an industrial <br />building at 3000 Centerville Road similar to the one on 3020 Centerville <br />Road. In planning for the construction of this new building, it was <br />discovered that the row of pine trees along Allen Avenue are actually on <br />the Peters property and not within the right-of-way. In order to save the <br />trees, the proposal is to move the lot line and the building north by 10 feet, <br />which will result in the lot at 3020 Centerville Road having a non- <br />conforming width. The Code requires a 150 foot width for industrial <br />properties, and the north lot would be 149 feet wide and the south lot 151 <br />feet wide. <br />The Planner noted that the standards for granting a Variance are that the <br />proposal must be reasonable and that there are practical difficulties unique <br />to the property that would interfere with establishing the proposed <br />reasonable use. The Planner noted that without the Property Division and <br />Variance, it would he necessary to remove the row of pine trees that <br />provides screening to the adjacent residential neighborhood.
