MINUTES <br />CITY COUNCIL <br />JULY 23, 2014 <br />and a side entrance that would access the upper unit. McManus indicated <br />that the house would have a walk -out with each unit have access to a <br />portion of the lower level. McManus indicated that the floor plans for <br />each unit would be close to the same. <br />Keis asked if he purchased this house if he could live in one unit and rent <br />the other to anyone. The City Planner noted that under the PUD District <br />restrictions for multi -family housing, both units would have to be <br />occupied by people aged 55 or older. The Planner indicated that the City <br />would not have the ability to restrict occupancy by family relationship, <br />however. Keis felt that this would be a difficult restriction to enforce. <br />Montour agreed. The City Planner also agreed that enforcement of the age <br />55 or older restriction would be difficult to enforce. The City <br />Administrator indicated that to his knowledge there are no other duplexes <br />in the City that are age restricted. <br />McGraw expressed concern about how this situation would work in the <br />future. He cited an example of when the original owner passes away and a <br />new owner wants to convert the house to a single-family home. The <br />Planner replied that it could, and the PUD District would not require the <br />age restriction for a single-family home. Keis asked what would happen if <br />a family member inherited the property was younger than 55 years of age, <br />and wanted to occupy a unit and rent the other. McManus stated that this <br />could not be done since there would be a deed restriction limiting <br />occupancy to individuals aged 55 or older. <br />Keis was concerned about the City's ability to regulate occupancy by age. <br />McManus again stated that it could be done via the deed restriction. He <br />indicated that there are single-family homes that are being occupied by <br />extended families and felt this was a better situation as family segments <br />have their own separate units. <br />Boss asked the reason for the age restriction for multi -family housing in <br />the PUD District. The City Planner indicated that when this area of the <br />City was rezoned to PUD District it was implied that there could be multi- <br />family housing developed within the PUD District. However, given the <br />City's policy to discourage new market rate multi -family development, the <br />age restriction was placed to limit any new multi -family to senior housing. <br />The City Planner indicated that this is not an uncommon practice as some <br />cities view senior multi -family housing more favorably than market rate <br />multi -family housing. <br />Keis asked if the duplex proposal met setbacks.
