MINUTES <br />PLANNING COMMISSION <br />AUGUST 14, 2014 <br />AMEND PUD -C <br />DISTRICT & <br />PUD PERMIT — <br />121 EAST <br />LITTLE <br />CANADA <br />ROAD — <br />POOLSIDE <br />4 <br />The City Planner reported that Poolside, 122 East Little Canada Road, has <br />requested an Amendment to the PUD -C District and a PUD Permit for <br />outdoor storage and outdoor display area. He noted that in 2010 this <br />property was rezoned to PUD -C from B-3 as a way to better manage and <br />regulate multiple buildings and uses on the site. At that time a specific <br />PUD Permit was approved. At that time the applicants indicated that they <br />expected to construct a new building on the property to contain storage <br />materials at some future point. With that in mind, the City approved a <br />three-year allowance for the temporary outdoor storage of pool sales <br />products and wooden pallets. That allowance expired in 2013 and the <br />applicant is in violation of the terms of their 2010 PUD Permit. As a <br />result, the applicant is asking to renew their permit to allow outdoor <br />storage to continue to take place. The Planner indicated that if the <br />Commission is in support of the request, he noted the recommended <br />conditions for approval outlined in his August 5, 2014 report. The Planner <br />specifically noted the recommendation that any outstanding conditions <br />from the 2010 approval be completed no later than October 31, 2014. <br />The Planner then reported that he received an email from David Dorn, <br />2739 Jackson Street, who indicated that he could not be present this <br />evening due to a family emergency. Dorn stated that he was opposed to <br />the request given the condition of the property, maintenance issues, and <br />failure to comply with the conditions of the 2010 permit. <br />The Planner noted the unusual aspect of this outdoor storage in that while <br />some outdoor display is allowed, outdoor storage is not. Under this PUD <br />Zoning, however, a temporary allowance for outdoor storage has been <br />made, but the understanding was that over time this outdoor storage would <br />he brought indoors. <br />The City Clerk reported that she spoke with David Dorn who indicated <br />that his opposition to tonight's proposal related to code compliance issues <br />related to grass cutting, dumpsters overflowing with stuff dumped <br />alongside, and unapproved outdoor storage occurring. Dorn indicated that <br />it was his understanding that the property owner was to build a building to <br />bring the outdoor storage inside. <br />Rob Anderson, Poolside, indicated that given the seasonal nature of the <br />business, there are times of the year that they get behind in property <br />maintenance. 1 -le indicated that they are now making a concerted effort to <br />clean up the area in the back. He noted that the majority of this area is not <br />visible, although there are some points where it is visible. Anderson <br />indicated that he had no problem with the recommendations of the City <br />Planner except for landscape screening of the outdoor storage area and for <br />-5- <br />10 <br />
