MINUTES <br />PLANNING COMMISSION <br />AUGUST 14, 2014 <br />EXTENSION <br />OF IUP PERMIT - <br />COUNTRY <br />DRIVE — <br />ERADOR <br />The City Planner reported that Frank Frattalone, FraDor, has requested <br />an extension of the Interim Use Permit for recycling and stockpiling of <br />gravel on his property at 3137 Country Drive. This property is zoned <br />General Industrial (1-2) District and is the only property with this zoning. <br />The 1-2 Zoning District was created for this specific property and use. The <br />Planner indicated that Frattalone sought the extension of its Interim Use <br />Permit (IUP) that was to expire in 2009, and the City approved an <br />additional 5 years. The IUP is set to expire this fall, and Frattalone is <br />again seeking a five year extension. The Planner noted that the terms of a <br />Development Agreement have been negotiated to govern the operational <br />details of this use. <br />Fischer noted that under the Development Agreement the use would <br />sunset in 2019 and the expectation would be that the property would be <br />repurposed. <br />Frank Frattalone, FraDor, appeared before the Commission requesting the <br />IUP extension. Frattalone indicated that he does not want to shut the <br />business down, but noted that the terms of the Development Agreement <br />call for the property to be Listed for sale. If a viable offer were to come in, <br />the property would be sold and the business shut down. Frattalone noted <br />the FraDor building that was constructed on the site which demonstrates <br />that a viable building can he developed on this property. He also pointed <br />out the landscaping that has been done on this property. Frattalone <br />indicated that he has done everything that the City has required and will <br />continue to work with the City. He acknowledged the City's desire to <br />have the property redeveloped with heavy industrial buildings. Frattalone <br />indicated that on occasion 11e receives complaints about dust from the <br />operation from the adjacent mobilehome park. He indicated that he has a <br />water truck on the site at all times, sweeps frequently, and works to do a <br />good job. He has always encouraged the City to conte and inspect the site. <br />Frattalone pointed out the property taxes he pays on this site in addition to <br />a fee in lieu of taxes paid directly to the City and based on tonnages out of <br />the recycling operation. Frattalone requested approval of the IUP <br />extension and indicated that if the property is not: sold in five years, it <br />would be his intention to request another extension. <br />Fischer noted the good appearance of the property as well as Frattalone's <br />efforts to be a good neighbor. Frattalone commented on his hours of <br />operation and his efforts to stay within City Code limitations. <br />Duray commented that Frattalone has done a great job with this business. <br />He asked the height of the recycling stockpiles. Frattalone reported that <br />Me maximum height allowed is 52 feet and they make every effort to not <br />-9- <br />23 <br />
