MINUTES
PLANNING COMMISSION
AUGUST 14, 2014
done. Anderson indicated that he was agreeable with that
recommendation provided the escrow amount was reasonable.
Fischer asked about the recommendation that the outdoor storage area be
paved. He asked if it was reasonable to not require paving if the outdoor
storage is truly to be temporary. Anderson indicated that the area is
surfaced with Class V and requiring paving would be a hardship.
The City Planner suggested that the Commission discuss the screening and
paving recommendations. Duray noted Anderson's earlier comments that
landscape screening would not survive along the fence area and asked
what other type of screening would be acceptable. The Planner indicated
that either landscaping or a solid fence would provide the needed
screening. Anderson noted that there is a solid fence along a good portion
of Jackson Street, but that the fenced changed to chain link in one small
area. Anderson suggested that he could put landscaping on the inside of
the chain link fence area. Maleitzke asked what the solid fence did not
extend the entire length along Jackson Street. Anderson reported that this
was the adjacent property owner's preference so that he could see out
through to County Road C.
Barraclough asked if not requiring paving of the outdoor storage area
would set a precedent. The City Planner noted that given the property is
zoned PUD, there would be no precedent. Fischer asked if paving was a
requirement of the previous PUD Permit. The Planner indicated that it
was his recollection that it was. Duray asked if it would be acceptable to
require the Class V surfacing for two years given the storage would be
temporary. The Planner indicated that the Commission could make that
recommendation.
Maleitzke suggested that in addition to the requirement that the property
be in compliance with conditions by 10-31-14, she suggested that an
inspection occur in perhaps July of 2015 to ensure that there is still
compliance. The City Planner indicated that the Commission could make
that recommendation as well. He indicated that once an approval is made
subject to conditions, the City's Code Enforcement Officer would conduct
an inspection of the property. The Planner did not that most of the City's
code enforcement is complaint based and occasionally occurs on a
discovery basis.
Duray asked if Anderson could be in compliance by 10-31-14. Anderson
replied that it could except for the asphalt paving recommendation.
Fischer felt that if the PUD Permit were for 3 years, asphalt paving should
be required. He indicated that he could support the Class V if the PUD
-6-
