MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />DISTRICT AND THE PUD PERMIT FOR OUTDOOR STORAGE <br />AND OUTDOOR DISPLAY AREA FOR 121 EAST COUNTY ROAD C, <br />POOLSIDE, WITH THE APPLICANT TO SUBMIT A TIMETABLE <br />AND ACTION PLAN DETAILING HOW THE PROPERTY WILL BE <br />BROUGHT INTO COMPLIANCE WITH THE <br />RECOMMENDATIONS OUTLINED BY THE CITY PLANNER IN <br />HIS AUGUST 7, 2014 REPORT AS MODIFIED BY THE PLANNING <br />COMMISSION AND INCLUDING THE STAINING OF THE <br />PROPERTY LINE FENCE AND THE MARKING OF THE <br />OUTDOOR STORAGE AREA RATHER THAN PAVING, AS WELL <br />AS REPORT ON HOW POOLSIDE WILL PREVENT NON- <br />COMPLIANCE FROM REOCCURRING IN THE FUTURE <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />EXTENSION Blesener opened the Public Hearing to consider the request for extension <br />OF INTERIM of an Interim Use Permit for processing and stockpiling of gravel in the <br />USE General Industrial (I-2) District for the FraDor operation on Country <br />PERMIT — Drive. Both the City Planner and the Planning Commission recommended <br />COUNTRY approval of the extension subject to compliance with the recommendations <br />DRIVE — of the City Planner as outlined in his August 7, 2014 report. <br />FRADOR <br />The City Planner reported that in October, 2008, FraDor requested an <br />extension of their interim use permit that allowed the stockpiling and <br />processing of aggregate recycling materials at 3137 County Drive. The <br />permit was due to expire in 2009. The City approved the IUP for an <br />additional five years, which is due to expire this fall. FraDor is seeking an <br />additional extension, under similar terms, which have been documented in <br />a proposed development agreement which was negotiated between the <br />applicant and the City Council. The Planner indicated that the Planning <br />Commission has recommended approval of a five-year extension. The <br />Planner recommended that the applicant be asked to verify the intention to <br />terminate the use following this new five-year term. <br />The City Administrator reported that a Development Agreement has been <br />negotiated with Frank Frattalone for a five-year extension of his Interim <br />Use permit. Some of the key terms of that agreement include that the <br />property must be listed for sale at a value determined by an appraisal, a <br />marketing report must be submitted every six months, and if the property <br />is sold, the recycling and stockpiling operation must be closed and the <br />property redeveloped. The Administrator noted that the Council and <br />Frattalone did not want to just shut down a viable business, but want to see <br />10 <br />
