MINUTES
CITY COUNCIL
AUGUST 18, 2014
keeping the property maintained were reasonable requests on the part of
the adjacent property owners.
Montour felt the situation was primarily that of Poolside being a good
neighbor. Montour stated that he would like to see Poolside provide a
timeline and a business plan for compliance with the recommendations.
Blesener suggested that action be tabled on the PUD requests pending
receipt of that information.
Dorn noted that the City's code enforcement is complaint based. He asked
the Council to review all the pictures that he submitted. He also noted that
past practice has been that Poolside does not maintain their property
unless the City receives complaints.
McGraw indicated that once the City has this timetable in place, it will be
a tool that the Code Enforcement Officer can use to ensure compliance.
McGraw felt that the business should be given a chance to rectify its
problems. He indicated that the City will look at the pictures and
suggested that the neighbors take additional pictures if problems continue.
McGraw pointed out to Anderson that Poolside must make sure that
delivery trucks are not parked on Jackson Street and that the road is not
blocked.
Dorn noted that there are no parking signs on the street. He also indicated
that there is a tenant in the building at Little Canada Road that has a lot of
trailers and other equipment parked as well as semis backing in and out
that block the road. It is his understanding that the business may be
corning in for a permit for outdoor storage.
The City Attorney recommended that the Council close the public hearing
and table action on the PUD requests pending the additional information
to be submitted by Poolside. There was discussion about the 60 -day time
period for City review, and it was noted that this matter can be tabled to
the September 10, 2014 meeting and still fall within the 60 -day review
period.
There was no one else at the meeting wishing to comment on this matter.
Upon motion by Montour, seconded by Boss, the public hearing was
closed.
Montour introduced the following resolution and moved its adoption:
RESOLUTION NO. 2014-8-155 — CLOSING THE PUBLIC HEARING
AND TABLING ACTION ON THE AMENDMENT TO PUD -C
9
