MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />McGraw asked about any liability that the City relative to liquor being <br />served in a place where under 21 individuals are present. The City <br />Attorney indicated that dram shop insurance would be required of the <br />applicant, and it would be his responsibility to ensure that underaged <br />liquor service did not occur. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Keis, seconded by Boss, the public hearing was closed. <br />Blesener indicated his opposition to the PUD Permit noting the two senior <br />citizen housing complexes within 30 feet of the proposed parking area for <br />Voodoo Live, the fact that there is not adequate on-site parking and off- <br />site <br />ffsite parking cannot meet Zoning Code requirements, the single-family <br />residents in the area that would be impacted by this business, the <br />comments made by three of the Planning Commissioners who have <br />experience with similar businesses. Blesener noted that the one <br />Commissioner that lived near a live music venue informed him that there <br />were still people running around his neighborhood as late as 5 a.m. <br />Blesener felt that Voodoo Live could hire the best security company <br />possible, but there would still be issues with crowd control after a music <br />event. <br />Boss indicated that a Louisiana -style restaurant with a small jazz band <br />might be a more acceptable alternative. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-8-157 — DENYING THE ARCHITECTURAL <br />REVIEW AND PUD PERMIT FOR A RESTAURANT -BAR -LIVE <br />MUSIC VENUE AT 27-47 LITTLE CANADA ROAD REQUESTED BY <br />CHRIS GNETZ, VOODOO LIVE, SUBJECT TO THE FACT THAT <br />OFF-SITE PARKING PROPOSED DOES NOT MEET THE CITY'S <br />ZONING CODE REQUIREMENTS, GIVEN THE NEGATIVE <br />IMPACT THAT THIS BUSINESS WOULD HAVE ON THE QUALITY <br />OF LIFE FOR SURROUNDING RESIDENTIAL AREAS, THE <br />CITY'S LACK OF ABILITY TO KEEP UNDERAGED INDIVIDUALS <br />FROM ATTENDING LIVE MUSIC EVENTS, AND THE FINDINGS <br />OF ACT OUTLINED BY THE CITY PLANNER IN HIS AUGUST 7, <br />2014 REPORT AS FOLLOWS: <br />1. The proposed use cannot demonstrate adequate parking on the <br />property, considering other retail uses present, to meet the requirements <br />of the City's zoning regulations. <br />20 <br />
