MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />REZONING & <br />VARIANCE — <br />430 LITTLE <br />CANADA <br />ROAD <br />RECESS <br />AMEND THE <br />ZONING CODE - <br />DEFINITION <br />OF FAMILY <br />2. The proposed use is likely to create noise and other impacts in the <br />portion of the property that abuts a residential area, and which would be <br />incompatible with the adjoining land uses. <br />3. There are no buffering or screening measures present or proposed <br />which would be able to mitigate the impacts of late night, outdoor <br />activity. <br />4. The site plan is inconsistent with the Zoning Ordinance and <br />Architectural Guideline documents in the provision of outdoor green <br />space and pedestrian facilities. <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the request for Rezoning of <br />municipal park property from Single -Family Residential (R-1) District to <br />Public -Semi -Public (P) District and a Variance to the required setback to <br />permit the reconstruction of an existing warming house shelter meeting <br />accessibility requirements at 430 Little Canada Road is scheduled for <br />consideration at a Public Hearing on Monday, August 25, 2014. <br />At this point in the meeting, 9:48 p.m., the Council took a short recess. <br />The meeting was reconvened at 9:57 p.m. <br />Blesener noted that the Planning Commission tabled action on Amending <br />the Zoning Code relative to the Definition of Family in Section <br />902.010.F.(d.) pending additional research by the City Planner and the <br />City Attorney. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-8-158 — TABLING ACTION ON AN <br />AMENDMENT TO THE ZONING CODE RELATIVE TO THE <br />DEFINITION OF FAMILY IN SECTION 902.010.F.(d.) PENDING A <br />RECOMMENDATION FROM THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />21 <br />
