MINUTES
CITY COUNCIL
AUGUST 18, 2014
overgrowth along the fence line. Dorn also indicated that at the Planning
Commission meeting Anderson talked about economic hardships, but then
indicated that he would be hiring someone to maintain the grass. Dorn
indicated that what Poolside says will happen does not actually happen.
Greg Ostenson, Jackson Street, requested that the City require that the
existing fence be restained as it looks bad.
Dorn noted that a portion of the fence along Jackson Street is chain link
rather than wood. He indicated that the neighbors would prefer the entire
length to be wood to provide screening. Dorn was concerned that
Poolside leveled off the area adjacent to the chain link fence and that they
would begin to use that area for additional storage. He noted the Planning
Commission recommendation that a landscape screen be planted inside of
the chain link fence.
Keis asked Dorn what he would like to see. Dorn stated that he would like
to see a good faith effort by Poolside to keep up and maintain this
property. He also requested that the outdoor storage area be blacktopped
so that the area is defined, and the outdoor storage can be easily enforced.
He also asked for some repercussions in the event that Poolside does not
comply with the conditions of their PUD Permit.
The City Planner indicated that if Poolside does not comply, the Council
has the ability to revoke the PUD Permit.
McGraw noted that in 2010 the indication was that a building would be
constructed so that the outdoor storage could be eliminated. He noted that
Poolside is still at this same place and no progress has been made toward a
new building. McGraw noted that Poolside has not answered the question
about the status of a future building. He also felt that a two year extension
was a lot to ask for. Anderson stated that he did answer the question, and
the answer is that he does not know. Anderson stated that he cannot
financially construct a new building given the economy from 2008
through Last year. Anderson indicated that he will conform to whatever
the City is requesting and will clean up the outdoor storage as well as the
landscaping. Anderson suggested that if the neighbors have a problem
with the condition of the property that they contact him and he will
address the situation. He stated that he would make more of an effort to
have someone responsible for maintenance.
Keis asked about trucks blocking Jackson Street. Anderson reported that
companies making deliveries to Poolside as well as Poolside employees
are award that the street cannot be blocked. He indicated that deliveries
are supposed to occur to their rented space along Little Canada Road.
7
