MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />The City Planner reported that in 2010 the City rezoned the Poolside <br />property from General Business (B-3) District to Planned Unit <br />Development (PUD) District in order to better manage and regulate the <br />multiple buildings and used on the site. In conjunction with the rezoning, <br />a PUD Peimit was approved for the property. At that time, the property <br />owner expected to construct a new building in the near future to move <br />some of the outdoor storage items into the building. The PUD Permit was <br />a temporary three-year allowance and allowed for the outdoor storage of <br />sales products and wooden pallets. That three-year permit expired about a <br />year ago, and outdoor storage is occurring in violation of the Code. The <br />applicant has asked to renew the PUD Permit for the outdoor storage, but <br />did not ask for a specific time frame for this permit. The Planner noted <br />that the Planning Commission recommended approval with some <br />modifications to the conditions recommended in the August 5, 2014 <br />planning report. Those modifications include allowing a two-year PUD <br />Permit, requiring an escrow deposit to ensure compliance with the <br />applicant indicating a reasonable amount would be acceptable, screening <br />along the west property line inside the fence area, allowing the outdoor <br />storage area to be surfaced with Class V materials, compliance to be <br />achieved by October 31, 2014 with a following up inspection by June 1, <br />2015. <br />Rob Anderson, Poolside, indicated that he is agreement with the City <br />Planner's recommended conditions as modified by the Planning <br />Commission. He indicated that his business is seasonal and when the <br />business intensifies, property maintenance issues have gotten away from <br />them. Neighboring property owners have complained, and when the <br />City's Code Enforcement Officer made contact with Poolside, Anderson <br />indicated that they have responded. Anderson stated that their goal would <br />be to either be in compliance within two years or they will move their <br />business. <br />Keis asked if compliance would be achieved within two years or will <br />Poolside start working to achieve compliance in two years. Anderson <br />indicated that he could not answer that question, but indicated that they <br />would comply. <br />David Dorn, Jackson Street, presented several pictures showing the <br />condition of the property. These pictures showed outdoor storage <br />occurring outside of the designated storage area and unscreened, the fence <br />with overgrowth and weeds along the fence, poor condition of the fence, <br />and delivery trucks blocking access in and out of Jackson Street. Dorn <br />noted that the outdoor storage area which was approved in 2010 consisted <br />of a 16 foot by 40 foot area.
