STATE OF MINNESOTA AMENDMENT OF LEASE Amendment No. 1 Lease No. 12067 THIS AMENDMENT No. 1 to Lease No. 12067, formerly known as PC0017, is made by and between the City of Little Canada, hereinafter referred to as LESSOR, and the State of Minnesota, Department of Administration, hereinafter referred to as LESSEE, acting for the benefit of the Minnesota Pollution Control Agency. WHEREAS, LESSOR and LESSEE entered into Lease No. PC0017, dated October 26, 2011 as may subsequently be amended, involving the lease of an air monitoring site located at 141 County Road B. East, in the City of Little Canada County of Ramsey, Minnesota 55117, as shown on Exhibit A: WHEREAS, the parties deem certain amendments and additional terms and conditions mutually beneficial for the effective continuation of said Lease; NOW THEREFORE, LESSOR and LESSEE agree to substitution and/or addition of the following terms and conditions, which shall become a part of Lease No. 12067 effective as of the date set forth herein. 1. TERMINATION NOTICE RESCINDED LESSOR and LESSEE hereby acknowledge that the Termination of Lease Notice dated July 14, 2014 is hereby rescinded. This Lease remains in full force and effect. 2. CHANGE IN "ACTING. FOR BENEFIT" Effective September 1, 2014, LESSOR and LESSEE hereby acknowledge that the "acting for the benefit" is hereby changed to Department of Health. 3. RENEWAL TERM This Lease shall be renewed for a period of four (4) years ten (10) months commencing November 1, 2014 and continuing through August 31, 2019 ("Renewal Term"), at the same terms and conditions as set forth in the Lease, except as otherwise provided herein. 4. RENT 4.1 Rent Payment LESSEE shall pay LESSOR rent for the Renewal Term in the sum of two thousand nine hundred and no/100 dollars.
