MINUTES <br />CITY COUNCIL <br />SEPTEMBER 10, <br />AMENDMENT <br />TO PUD -C AND <br />PUD PERMIT — <br />121 EAST <br />COUNTY <br />ROAD C — <br />POOLSIDE <br />2014 <br />Blesener opened the continuation of Public Hearing to consider the <br />application for Amendment to PUD -C District and PUD Permit for <br />outdoor storage and outdoor display area for Poolside at 121 East County <br />Road C. It was noted that the City Planner recommended approval subject <br />to conditions outlined in his August 5, 2014 report and the Planning <br />Commission recommended approval subject to those same conditions with <br />some modifications. The Council tabled action on this matter at their <br />August 18, 2014 meeting pending submission of a timeline from the <br />applicant as to how the property will be brought into conformance with the <br />recommendations of the City Planner as outlined in his August 5th report <br />as modified by the Planning Commission and including the staining of the <br />property line fence and marking of the outdoor storage area rather than <br />paving. The applicant was also asked to provide a report for how they <br />would prevent non-compliance in the future. <br />The City Administrator reported that Poolside has submitted a plan <br />indicating that compliance will be achieved for items 5, 6, 7, and 12 in the <br />City Planner's report by October 15, 2014. The plan indicates that the <br />outdoor storage area shall be surfaced with Class V, and that the property <br />is already in compliance with items 10 and 11. Poolside also indicated <br />that the outside of the wooden privacy fence will be stained by September <br />30, 2014. With regard to maintaining compliance, Poolside has enacted a <br />policy that all materials will be restricted to the designated outdoor storage <br />area or stored indoors. A grounds maintenance company will be hired to <br />maintain property from April through July after which Poolside will be <br />able to maintain the property for the remainder of the year. <br />The Council discussed the length of the PUD extension, and it was the <br />consensus of the Council to grant a two-year extension from today's date. <br />Keis noted that if the property falls into non-compliance, then enforcement <br />action will be taken and the PUD Permit revoked. <br />Rob Anderson, Poolside, indicated that most of the property issues are <br />now in compliance, but they do have a few storage items to correct. With <br />regard to staining the fence, he indicated that Poolside began staining the <br />inside of the fence, but he was not yet sure that the staining improved the <br />appearance. If it does not, Anderson indicated that he would discuss this <br />with the neighboring property owners and would either complete the <br />staining or leave the outside of the fence natural if that is their preference. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Boss, seconded by Montour, the public hearing was <br />closed. <br />2 <br />
