MINUTES <br />CITY COUNCIL <br />SEPTEMBER 10, 2014 <br />TOBACCO The City Clerk reported that the owner of the Market Place Shopping <br />ORDINANCE Center has inquired about the possibility of the issuance of a tobacco <br />license to the operators of Daubers Cafe. The owner has submitted a <br />diagram which proposes the designation of approximately 250 square feet <br />of space at the back of the cafe to the sale of tobacco products. The Clerk <br />indicated that the City has two classes of Tobacco Licenses: Tobacco <br />Store License and General Tobacco Sales & Display License. There are <br />no Tobacco Store Licenses available at this time. The Clerk indicated that <br />in reviewing the ordinance, it was her concern that the ordinance does not <br />adequately define General Tobacco Sales & Display License. Therefore, <br />the City Attorney was asked to review the ordinance and determine <br />whether or not further definition was needed. The Clerk noted the City <br />Attorney's September 5, 2014 memo expanding the definition for General <br />Tobacco Sales & Display License as well as suggesting additional <br />ordinance language that provides the City with more flexibility in granting <br />or denying Licenses. The City Clerk recommended that the City <br />Attorney's proposed definition of General Tobacco Sales & Display <br />License be expanded to include gas station and/or convenience stores, <br />grocery stores, and drug stores. <br />Montour expressed concern that the 250 square feet of space that was <br />suggested for tobacco sales within Daubers Cafe was more than what is <br />typical for a General Tobacco Sales & Display License. Montour was also <br />concerned about the back entrance that would be used to access the area <br />that would be designated for tobacco sales and that area appears to be <br />segregated from the general customer area of the restaurant. Montour <br />expressed concern about signage and asked if the City could restrict <br />tobacco sales -related signage from this back door area. Montour indicated <br />that the layout of the tobacco sales area has more of an appearance of a <br />tobacco store than accessory tobacco sales that would be allowed by a <br />General Tobacco Sales & Display License. <br />The City Clerk noted that the diagram of the space was not available at the <br />time that the City Attorney reviewed this issue. She suggested that the <br />Council's concerns and the layout be forwarded to the City Attorney for <br />additional review. The Council agreed. <br />MAYOR & The City Administrator reported that the Mayor and Council Member <br />COUNCIL salaries have not been increased since 2009, and it was a number of years <br />SALARIES previous to 2009 that an increase had occurred. The Administrator <br />indicated that if the Council wishes to consider an increase at this time, <br />any increase approved cannot take effect until the November 4th municipal <br />6 <br />
