TRAIL EASEMENT MAINTENANCE AGREEMENT <br />THIS AGREEMENT is made this day of , 2014 by and between <br />the City of Little Canada (hereinafter referred to as "City) and Derek J. Owens and Kathleen S. <br />Mahan, husband and wife (hereinafter referred to as "Owner") with reference to the following <br />facts and circumstances: <br />WHEREAS, Owner purchased certain real property from City situated in the city of Little <br />Canada, Ramsey County, Minnesota, legally described as follows: <br />The North 121.42 feet of the South 619.75 feet of that part of the Northeast Quarter of the <br />Northwest Quarter of Section 4, Township 29, Range 22, lying Easterly of St. Paul an <br />Centerville Road (now called Labore Road), Ramsey County, Minnesota. <br />Reserving an easement to the Grantors for purposes of establishing a walking trail over <br />the Easterly 50 feet of the subject property as said 50 feet is measured parallel to the <br />Easterly boundary of the above described parcel. <br />(hereinafter referred to as "Property"), and <br />WHEREAS, City and Owner wish to detail Owner's responsibility for maintaining and/or <br />developing the easement area, <br />NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: <br />1. The City shall bear all costs associated with developing and maintaining any trail system <br />within the designated easement area. <br />2. The City may develop or construct the trail within the easement area at any time in the future <br />at its sole discretion. <br />3. Owner shall not use the easement area so as to restrict, hinder, or conflict with City's trail <br />usage in any manner in the easement area. <br />4. City does not intend to conduct any maintenance of the easement area prior to the <br />development of a trail in the easement area. The intent shall be to keep the easement area in <br />a condition consistent with the surrounding properties and wetland areas and to minimize <br />disturbance to same. <br />5. The terms and conditions of this Agreement shall be binding upon, and shall inure <br />to the benefit of the parties hereto and their respective successors and assigns. <br />2 <br />
