c. One (1) or more persons occupying a premises, subject to a limit of not <br />more than three (3) unrelated persons eighteen (18) years of age or <br />older. The definition of family is established for the purpose of <br />preserving the character of residential neighborhoods by <br />controlling population density, noise, disturbance and traffic <br />congestion and shall not be applied so as to prevent the city from <br />making reasonable accommodation where the City determines it <br />necessary under applicable federal fair housing laws. <br />d. Group residential facilities meeting the definition in this code, when <br />property licensed by the Minnesota Department of Human Services <br />or the Minnesota Department of Corrections under MN Stat. <br />245A.11 and 241.021, or such facilities that are registered with the <br />State of Minnesota, pursuant to MN Stat. 14I A, as may be <br />amended. <br />G. 4.5 — Group Home, Group Residential Facility. Those facilities meeting the <br />requirements of the State of Minnesota for licensing and/or registration, and <br />which are required by Minnesota Statutes to be allowed as single family dwellings <br />for purposes of zoning. Such facilities may include a single attached caretaker <br />unit accommodating up to two (2) caretaker staff beyond the residence population <br />limits identified in the Statute. Such caretaker unit, if provided, may not be <br />utilized for residents being provided services in excess of the allotted number of <br />residents allowed by Statute or other applicable regulation <br />The proposed changes cited above are intended to accommodate the requirements of <br />the State of Minnesota that require cities to allow group homes in residential <br />neighborhoods. The most common practice of the State is now to register (rather than <br />license) most of the organizations that provide these residential services. Since care for <br />some of the populations is 24 hours, a caretaker unit is often included for the care <br />providers to live on the premises. This amendment is intended to incorporate these <br />changes in law and practice related to group homes. <br />Summary and Recommendation <br />Planning staff recommends approval of the amendment to reflect changes in both law <br />and practice related to residential group home facilities. <br />pc: Kathy Glanzer <br />Steve Westerhaus <br />Lee Elfering <br />12 <br />
