Hanson TO: Mayor Blesener and Members of the City Council FROM: Jessica Jagoe, Code Enforcement Officer DATE: December 10, 2014 RE: 200 & 202 Ryan Drive — Appeal Hearing On November 12, 2014, the City Council directed staff to proceed with the notice of revocation for the Indoor Retail Sales Licenses at Nova Auto, 200 Ryan Drive and Pony Auto Sales, 202 Ryan Drive based on the fact there is no building to operate out of. Those notifcations were mailed out November 18th and instructed both businesses of their opportunity to appeal this decision (copy of notices attached). Below I have copied the city code with regards to revocation of said license: 803.050. NOTICE OF REVOCATION. The Council may upon ten (10) days written notice, require the licensee to show cause as to why his license should not be revoked if he, fails to live up to the provisions of this Chapter or to any special provisions required by the Council at the time of the issuance of the license. Upon failure to show cause the licensee's rights may be terminated by the Council. On November 2401 both businesses submitted their written appeal of the proposed revocations. Included with this memo is their request. Staff felt it was worth noting to the City Council that in discussion with Reabar Abdullah (Pony Auto Sales) staff did ask how or where he is operating his retail sales since the lire. IIis response was that he has cars stored in various locations because they don't have a new location. Ile added that some of his cars are on other properties in Little Canada specifically mentioning Amtec Auto and Seren Auto Sales. On another visit, Mr. Abdullah came into city offices with the owner of 13alta's Towing. They were asking 1
