about the possibility of combining Balta's Towing and Pony Auto Sales out of Lee <br />Rossow's building at 3164 Ryan Lane. He indicated they have already moved some cars <br />to this location. Staff informed both parties that this location does not have an active <br />Conditional Use Permit for Indoor Retail Sales that would allow them to just transfer <br />their license. (In fact, we are not aware of any property in Little Canada that does.) Staff <br />gave both business owners a copy of the 1-1 Zoning District standards so they could <br />review requirements if they would pursue the needed approvals. <br />Additionally, staff reviewed how the current code requires a separation of auto repair <br />space and indoor sales areas. The Balta's Towing location that they have shifted ears to <br />would not comply with the requirements to be issued a CUP in its current building layout. <br />Staff believes this could be a code enforcement issue because at our last inspection for <br />Balta's Towing his repair use occupied the entire building. <br />Furthermore in February 2013, Pony Auto Sales was sent a notice of violation for <br />conducting outdoor retail sales as observed by the Fire Marshal. Staff believes there is a <br />potential issue involving which vehicles are outdoor storage versus being sold outdoors if <br />that would be allowed in this new location. <br />Staff indicated to both parties that if the Council directs staff to proceed with the <br />revocation of the indoor retail sales licenses, code enforcement action would be taken on <br />vehicles that remain in the City illegally. <br />City staff's recommendation is to deny the appeal of the revocation of the indoor retail sales <br />licenses for both Nova Auto Sales at 200 Ryan Drive and Pony Auto Sales at 202 Ryan Drive <br />based on the fact there is no building to operate out of. Additionally, staff recommends <br />proceeding with notification to the State Dealers Division of the revocation due to this <br />property no longer complying with zoning requirements to operate. <br />CC: Nova Auto Sales <br />Pony Auto Sales <br />2 <br />
