MINUTES <br />CITY COUNCIL <br />NOVEMBER 24, 2014 <br />MAINTENANCE <br />AGREEMENT — <br />3046 LABORE <br />ROAD <br />AUTHORIZE <br />PAYMENT OF <br />ADDITIONAL <br />COSTS FOR <br />VETERANS <br />MEMORIAL <br />*CERTIFY DELINQUENT UTILITY AND DEVELOPMENT <br />BALANCES; <br />*AUTHORIZE SUBMISSION OF SCORE GRANT APPLICATION; <br />*CALL COUNCIL WORKSHOP MEETING TO CONDUCT CITY <br />ADMINISTRATOR'S PERFORMANCE EVALUATION; <br />*CALL COUNCIL WORKSHOP MEETING TO REVIEW <br />MUNICIPAL CONSENT FOR MnPASS PAHSE H PROJECT; <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the City closed on the sale of <br />3046 LaBore Road last week. At the closing it was discovered that the <br />closing company failed to address the City's retainage of a 50 -foot trail <br />easement over the property. That was corrected on the deed, but the title <br />company then requested that the City provide a trail easement <br />maintenance agreement which states that the City is responsible for <br />construction and maintenance of any future trail on that easement. The <br />Administrator submitted a proposed trail maintenance agreement to the <br />Council for approval. He noted that the title company has reviewed and <br />approved this agreement. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-11-217 — APPROVING THE TRAIL <br />MAINTENANCE AGREEMENT FOR 3046 LABORE ROAD AND <br />AUTHORIZING THE ACTING MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the first phase of the Veterans <br />Memorial Park Project is virtually complete. He submitted to the Council <br />an accounting of the project costs. The Administrator noted that the City <br />previously committed to paying the costs of the parking bay and the <br />sidewalk work at an estimated cost of $36,000. The Administrator pointed <br />out that as the project moved forward, that estimated increased to $58,045, <br />2 <br />
