Reimbursement of Little Canada Rd Bridge Costs—This issue took some digging into which is why I couldn't respond as <br />quickly as I hoped from when we talked on the phone. According to the agreement entered into to perform the work <br />MnDOT did reimburse the City $50,000. It Is my understanding that now the City is seeking reimbursement of the <br />remaining ^'$77,000. The agreement signed identified that MnDOTs complete share of the costs were $50,000. (See <br />copy of that agreement below). It now appears that the City has placed a condition on the resolution to revisit this <br />agreement and be reimbursed 100% of the construction costs. As discussed at our meeting based on how a project is <br />initiated the State is held to certain cost participation policies. Deviation from those have to done via an exception that <br />the Chief Engineer reviews and signs along with the District Engineer. Outside of that process is a violation of state <br />statutes. In Wayne's response to the conditions he stated that a direct reimbursement could not be made (as it would <br />be a violation of statutes.) A pass through with the County was suggested, which may or may not be possible. Sine this <br />issue is rather complex from a legal standpoint I think we may need further discussion.
