EDAs and port authorities <br />An economic development authority (EDA), port authority, or seaway port <br />authority may contract with firms engaged in the business of importing, <br />exporting, or general trade that employ one of its commissioners. <br />Procedure: <br />• The interested commissioner abstains from voting on the matter. <br />• The authority approves the contract by unanimous vote. <br />• The commissioner does not take part in the determination (except to <br />testify) and abstains from any vote that set any rates affecting shippers <br />or users of the terminal facility. <br />1. Bank loans or trust services <br />Banks that employ a public housing, port authority, or EDA commissioner <br />may provide loans or trust services to property affected by that authority. <br />Procedure: <br />• The commissioner discloses the nature of those loans or trust services <br />of which he or she has personal knowledge. <br />• The disclosure is recorded in the meeting minutes. <br />• The interested commissioner abstains from voting on the matter. <br />• The authority approves the contract by unanimous vote. <br />Construction materials or services <br />(cities with a population of 1,000 or less) <br />A city with a population of 1,000 or less (according to the last federal <br />census) may contract with one of its officers for construction materials <br />and/or services through a sealed bid process. <br />Procedure: <br />• The interested officer abstains from voting on the contact. <br />• The council approves the contract by unanimous vote. <br />k.
