The nature of the <br />applicant's business is the sale of puppies of small breeds that are less than eight <br />pounds, and are kept indoors. The applicant indicates that there would be no outdoor <br />runs, and waste will be collected and collected in bags and disposed of in the building's <br />dumpster. The applicant indicates that the puppies sold in the store will be up to two <br />months old. <br />Both the B-3 and B-4 Districts are intended to serve as commercial retail and service <br />centers for the area. The retail sales of pet supplies would be consistent with this intent. <br />The keeping and sale of animals raises the prospect of unique issues that are not faced <br />by other retailers, however. <br />As such, staff is recommending that the amendment, if approved, be written to allow pet <br />supplies as a permitted use, but live animal pet sales be allowed only by Conditional <br />Use Permit. The CUP requirement will give the City the ability to consider location, as <br />well as the needs of live animal care as it relates to the potential impacts on surrounding <br />land uses. <br />13 <br />
