The amendment would include the following: <br />Permitted use: <br />• Retail sales of pet supplies and goods, but not live animals. <br />Conditional Use: <br />• Retail sales of domestic pet animals, subject to the following: <br />1. All dogs and cats shall be subject to the provisions of City Code Section <br />1101, "Dogs and Cats". <br />2. The premises shall maintain a kennel license if the number and age of <br />animals kept on the property meet the requirements of Dog Kennel as <br />defined in the Zoning Ordinance. <br />3. Animals kept under this section shall only be domestic pets, limited to <br />dogs, cats, indoor domestic birds kept in cages, or fish and reptiles kept in <br />aquariums or terrariums, and shall include no animals defined as livestock <br />or as non -domesticated animals in the City Code, Sections 1103 and <br />1105, respectively. <br />4. Animals kept under this section shall not be displayed or exercised <br />outdoors, and shall at all times be kept inside the portion of the building <br />identified in the Conditional Use Permit approval. <br />5. The proprietor of the business shall ensure that the premises is kept in a <br />clean and sanitary condition at all times. <br />6. The proprietor of the business shall define, as a condition of the <br />Conditional Use Permit, a method for waste collection and disposal that <br />does not rely on the City's sanitary sewer system. <br />7. The business shall create no odors that are detectable to adjoining <br />tenants or properties. <br />8. Animals which cannot be humanely kept under the terms of the CUP shall <br />not be allowed on the premises. <br />9. The City may condition inspections of the business property to ensure <br />compliance with the terms of the ordinance and CUP. <br />10. Other conditions deemed appropriate by the City Council. <br />The City Code includes the following definitions that are relevant to this amendment: <br />Non -domesticated animal: any wild animal, reptile, or fowl which is not naturally <br />tame or gentle, but is of a wild nature or disposition, and which, because of its <br />size, vicious nature, or other characteristics would constitute a danger to human <br />life or property. The term includes animals and birds, the keeping of which is <br />licensed by the State or federal government, such as, wolves, raptors, and <br />pheasants. By way of example and not of limitation, the term includes: snakes, <br />eagles, ocelots, jaguars, cougars, weasels, wild ferrets, badgers, monkeys, <br />chimpanzees, deer and bison. <br />14 <br />
