Livestock: It shall be unlawful for any person to keep, raise, breed or feed <br />livestock more specifically set forth as cows, steers, cattle of any kind, horses, <br />sheep, goats, lambs, pigs, or any other domesticated farm animal raised and/or <br />maintained for food, produce, breeding, dairying, or other recognized farm <br />income livestock operation in the City. It shall also be unlawful for any person to <br />keep, raise, breed, or feed poultry and/or pigeons within the City. <br />With regard to the CUP application proposed under this amendment, the applicant's <br />materials appear to show that she can meet the conditions identified in the language as <br />written. The applicant indicates that the dogs will be kept in display or sleeping crates, <br />depending on the time of day, and that no outdoor activities are required due to the size <br />of the dogs. She further indicates that the puppies are likely to be up to two months in <br />age, which would be lower than the threshold age for kennel licensing to start. <br />Summary and Recommendation <br />Staff believes that the intent of the zoning districts would be consistent with retail sales <br />of pets and pet supplies, and is supportive of an amendment. To ensure that live <br />animal sales is consistent with other code provisions, that aspect of the use is proposed <br />to be allowed only by Conditional Use Permit, whereas supplies could be retailed as a <br />permitted use. <br />The applicant's proposed use of the property appears to be compatible with the <br />requirements of the amendment language, subject to the various requirements for <br />licensing, sanitation, and kenneling. With these conditions, planning staff recommends <br />approval of the proposed amendment to the B-3 and B-4 districts allowing pet supplies <br />as a permitted use, and live domestic pet sales as a conditional use. <br />If the amendment is adopted, staff recommends approval of the CUP for 2526 Rice <br />Street, subject to the provisions of the ordinance and the representations made by the <br />applicant in her application materials. <br />pc: Kathy Glanzer <br />Steve Westerhaus <br />Lee Elfering <br />15 <br />
