MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2015 <br />City Administrator reported that in some cases the City has required that <br />the property be resurveyed to ensure compliance with the grading plan. <br />Faschinger asked if the maintenance agreement would include the <br />retaining wall. The City Administrator replied that it could. The <br />Administrator noted that the maintenance agreement would be recorded <br />against the property and would become part of the title so that future <br />property owners are aware of their responsibilities. <br />Faschinger asked about tree replacement. The City Planner indicated that <br />the City Code requires tree replacement a maximum of 30 caliper inches <br />per acre for trees removed outside the building area. <br />Boettner again asked about the walking easement across her property. The <br />City Administrator suggested that the City Attorney could review the <br />easement and comment on it, but pointed out that the City has no authority <br />with regard to this easement. The City Planner stated that the walking <br />easement is a private legal easement. <br />Montour also pointed out that given the drainage pipe could be <br />directionally bored, that would minimize the impact on existing trees. The <br />Engineer replied that that was correct as no excavation would be necessary <br />for installation of the pipe, perhaps only at the ends of the pipe. <br />Torkelson asked if the pipe easement is necessary in order to proceed with <br />the development of this property. The City Engineer noted that the rain <br />water garden as proposed, without the drainage pipe, meets the City's <br />standard requirements. The Engineer indicated, however, that he requires <br />additional improvements in certain circumstances. The City <br />Administrator noted that without the ability to put in the pipe, the <br />Engineer can require that the rain water garden be made larger to contain <br />run-off on site. <br />Fischer noted that the design will result in no run-off onto the Boettner <br />property as the result of a two-year event. Fischer asked about the pipe <br />directing run-off across Keller Parkway. The City Engineer indicated that <br />that unless the run-off is directed into a ditch or storm water system, there <br />would be run-off across the road as the result of a larger rain event. The <br />City Administrator indicated that a permit may be required from Ramsey <br />County relative to storm water drainage in the area of Keller Parkway, and <br />he did not believe the County would allow run-off being directed onto <br />Keller Parkway. The Administrator also suggested that the Watershed be <br />contacted relative to the storm water management plan for this property. <br />6 <br />
