MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2015 <br />planning and zoning authority. The Planner stated that it is his position <br />that the proposed property division meets the Code subject to compliance <br />with grading and drainage requirements. <br />Keis indicated that the property is a legally splitable lot that meets Code <br />requirements and that drainage requirements will be met; therefore, there <br />is no reason to not approve the suhdivision. Montour pointed out that <br />there is no firm resolution as to how the drainage will he addressed <br />pointing out that Boettner may not grant the drainage easement. Keis <br />noted that if that is the case, the City Engineer's recommendation is that <br />the rain water garden be re -engineered and increased in size. The City <br />Administrator suggested that an approval could be conditioned upon the <br />drainage easement being granted and, if not, the matter would have to <br />come back to the Council for additional review. <br />Torkelson stated that if the drainage easement is not granted, then the plan <br />will have to be redrafted increasing the size of the rain water garden. <br />Torkelson stated that his preference was to review that plan, if need be. <br />He supported a conditional approval with the drainage being piped, and if <br />the easement is not granted, then the subdivision must come back to the <br />Council for review. <br />Torkelson introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-2-37 —APPROVING THE SUBDIVISION <br />OF 716 LABORE ROAD INTO TWO SINGLE-FAMILY LOTS AS <br />PROPOSED BY JERRY CARLSON, EXCEPTIONAL HOMES BY <br />DESIGN, SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AND THE CITY <br />ENGINEER, SUBJECT TO THE DEDICATION OF A DRAINAGE <br />EASEMENT AND THE PIPING OF STORM WATER TO THE <br />SOUTH AS REVIEWED AND APPROVED BY THE CITY <br />ENGINEER, AND SUBJECT TO THE DEDICATION OF A <br />MAINTENANCE AGREEMENT FOR BOTH THE DRAINAGE <br />SYSTEM AND THE RETAINING WALL, AND PROVIDED THAT IF <br />THE STORM WATER EASEMENT IS NOT DEDICATED, THIS <br />PROPERTY DIVISION WILL NOT BE CONSIDERED APPROVED <br />AND THE APPLICANT WILL NEED TO SUBMIT A MODIFIED <br />RAIN WATER GARDEN STORM WATER PLAN THAT MEETS THE <br />CITY ENGINEER'S APPROVAL TO THE CITY COUNCIL FOR <br />RECONSIDERATION OF THE SUBDIVISION APPROVAL <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0).
