MINUTES <br />CITY COUNCIL <br />MARCH 11, 2015 <br />AMEND <br />ZONING CODE <br />& CUP — <br />2526 RICE <br />STREET — <br />W ISEMAN <br />Keis opened the Public Hearing to consider an Amendment to the Zoning <br />Code to provide for pet supply and pet sales as an allowed use in the <br />General Business (B-3) District and the Comprehensive Business (B-4) <br />District and a Conditional Use Permit to allow the operation of a pet <br />supply and pet sales business at 2526 Rice Street requested by Mark and <br />Nicole Wiseman. It was noted that the Planning Commission <br />recommended approval of both the Zoning Code amendment and the <br />Conditional Use Permit subject to the conditions recommended by the <br />City Planner in his February 27, 2015 report. <br />The City Administrator reviewed the Planner's February 27, 2015 report <br />noting that Nicole Wiseman is seeking an amendment to the Zoning <br />Ordinance to establish an allowance for pet sales and supplies in both the <br />13-3 and B-4 Zoning Districts. Wiseman is also requesting a Conditional <br />Use Permit to operate a pet supply and pet sales store. The Administrator <br />noted that the property at 2526 Rice Street is zoned B-3. The City <br />Administrator reported that the City Planner is recommending approval of <br />the Zoning Code Amendment which would allow pet supply sales as a <br />permitted use in both the B-3 and 13-4 Districts and pet sales as a <br />conditional use in each district subject to a list of conditions. The <br />Administrator reviewed those conditions some of which include <br />compliance with the City's Animal Ordinance, the requirement for a <br />kennel license if necessary, a limitation that pet sales be restricted to <br />domestic pets as defined by City Code, animals be kept indoors and not <br />displayed or exercised outdoors, that the premises be kept clean and odor <br />free, and waste be disposed of properly. <br />Tom Duray, owner of 2526 Rice Street, reported that the building consists <br />of two rental units, each of which is 1,200 square feet in size. One half is <br />currently rented to Papa Murphy's and the other will be rented to The <br />Puppy Place, if the Council grants the necessary zoning approvals. Duray <br />described the proposed lease for The Puppy Place. I -Ie also indicated that <br />he has had three other parties interested in leasing this space, but felt that <br />The Puppy Place would be the best user of this space. Duray indicated <br />that Papa Murphy's has no objection to the proposal before the Council. <br />Keis noted that the business plan is to sell only puppies, and asked what <br />will happen if a dog does not sell. Mark Wiseman indicated that once a <br />puppy reaches four to five months in age, the price will be discounted. If <br />a puppy reaches the age of six months, it is likely that they will work with <br />the Humane Society or by some other method to place the dog with a <br />family who might not otherwise be able to afford to purchase the type of <br />dog they will be selling. <br />2 <br />
