MINUTES <br />CITY COUNCIL <br />MARCH 11, 2015 <br />Montour asked how puppies will be obtained. Wiseman reported that they <br />will work with breeders throughout the Midwest and will not purchase <br />puppies from puppy mills. Wiseman indicated that the breeders they will <br />work with are USDA regulated. <br />McGraw asked if there were any State regulations relative to pet stores. <br />The City Administrator reported that there are some statutory <br />requirements relative to disclosures that pet dealers must make to retail <br />purchasers. <br />Torkelson asked why the dogs would not be exercised outside. Wiseman <br />reported that these are very small puppies that do not like to go outside, <br />especially during cold weather. <br />Fischer noted that the City Planner is recommending as an ordinance <br />condition that animals must be kept inside at all times. He pointed out that <br />Wiseman plans to keep the puppies inside, but the next pet store owner <br />may not have that same plan. Keis noted that the CUP would run with the <br />property, and that a new owner would have to comply with the Code and <br />all conditions placed on the CUP. <br />McGraw asked if there were any inspection requirements. The City <br />Administrator indicated that there is a statutory provision addressing <br />health conditions, but he was not sure who was responsible for <br />enforcement. The Administrator indicated that he would do additional <br />research to determine this. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Montour, seconded by McGraw, the public hearing was <br />closed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-3-44 —AMENDING THE ZONING CODE <br />TO PROVIDE FOR PET SUPPLY STORES ASA PERMITTED USE <br />AND PET SALES STORES AS A CONDITIONAL USE AS <br />RECOMMENDED BY THE CITY PLANNER IN HIS FEBRUARY 27, <br />2015 REPORT <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />3 <br />
