General Conditions <br />3.1.1. All materials used in the Work shall be new and of good duality unless otherwise provided for <br />in the Contract Documents, shall meet the requirements of the Executive Overview, General and <br />'technical Provisions, Special Provisions, Drawings, and Equipment Lists, and shalt not be <br />incorporated into the Work until reviewed by the Owner. If required by Owner, Contractor shalt <br />furnish satisfactory evidence (including reports of required tests) as to the kind and quality of <br />materials and equipment. <br />3.1.2 All materials and equipment shall be applied, installed, connected, erected, used, cleaned and <br />conditioned in accordance with the instructions of the applicable manufacturer, fabricator, supplier <br />or distributor, except as otherwise provided in the Contract Documents. <br />3.2 STORAGE OF MATERIALS <br />Materials shall be so stored by the Contractor as to insure the preservation of their quality and fitness <br />for the Work. <br />3.3 CONTRACTOR'S WORKERS <br />3.3.1 Important communications shall be confirmed by the Owner in writing. Other communications <br />shall be so confirmed upon written request of the Contractor. It shall be the responsibility of the <br />Contractor to coordinate the work of all the subcontractors. The Contractor shall coordinate with <br />others perfortning contracts in connection with the Work of the Contractor. <br />3.3.2 Cr the Contractor, in the course of the work, Ends any discrepancy in the contract documents, or <br />any errors or omissions in drawings, or in the layout and given instructions, it shall be his/her duty to <br />immediately inform the Owner, in writing, and the Owner shall promptly verify the same. Any work <br />clone after such discovery until authorized, will be done at the Contractor's own risk. <br />3.3.3 The Contractor shall at all times be responsible for the conduct and discipline of its employees <br />and/or any subcontractors. All workers must have sufficient knowledge, skill and experience to <br />perform properly the work assigned to them. Any foreman or worker employed by the Contractor or <br />subcontractor who does not perform work in a skillful manner, or appears to be incompetent or to act <br />in a disorderly or intemperate manner shall be discharged immediately and shall not be employed <br />again in any portion of the Work. <br />3.4 WARRANTY AND GUARANTEE <br />Contractor warrants and guarantees to Owner that all Work will be in accordance with the Contract <br />Documents and will not be defective. Prompt notice of all defects shall be given to Contractor. All <br />defective Work, whether or not in place, may be rejected, corrected or accepted as provided in <br />Paragraph 3.8. <br />3.5 ACCESS TO WORK <br />Owner's representatives, testing agencies and governmental agencies with jurisdictional interests will <br />have access to the Work at reasonable times for their observation, inspection and testing.
