General Conditions duties and responsibilities for the safety and protection of the Work shall continue until such time as all the Work is completed and Owner has issued a notice to Contractor that Work is acceptable. 4.3.4 Contractor agrees to indemnify the Owner and their agents and employees against all claims, demands, losses, damages and expenses (including attorneys' fees) arising out of or resulting from the Contractor's violation of any safety law, regulation or code (including without limitation OST -IA) or any other prudent precaution. 5. MEASUREMENT AND PAYMENT 5.1 REQUEST FOR PAYMENT The Contractor may submit periodically, but not more than one each month unless otherwise approved by the Owner, documentation summarizing work completed to date in the performance of the Contract including measured quantities and associated unit prices in a tabulated format a ("Request for Payment") for Work done and materials delivered and stored on the site. Payment for materials stored on the site will be conditioned on the following: A. The Contractor shall submit evidence to establish the Owner's title to such materials. 13. Acceptable provisions have been made for storage. C. The Contractor shall provide and maintain insurance against all loss, theft, vandalism, damage and similar peril for the full value of the stored material. The insurance on the stored material shall name the Owner as insured. 5.2 OWNER'S ACTION ON A REQUEST FOR PAYMENT Within thirty (30) days of submission of any Request for Payment by the Contractor, the Owner shall: A. Pay the Request for Payment as submitted. The Owner may retain a percentage of payment in the amount up to five (5) percent (hereinafter "Retainage") until final payment on the Contract; or B. Pay such other amount in accordance with Section 5.3 as the Owner shall decide is due the Contractor, informing the Contractor in writing of the reason(s) for paying the modified amount; or C. Withhold payment in accordance with Section 5.3, informing the Contractor in writing of the Owner's reasons for withholding it. 5.3 CONTRACTOR'S OBLIGATIONS '10 SUBCONTRACTORS The Contractor shall pay any subcontractor within ten clays of the Contractor's receipt of payment from the Owner for undisputed services provided by the subcontractor. The Contractor shall pay interest of one and one-half (I-1/2%) percent per month or any part of a month to the subcontractor on any undisputed amount not paid on time pursuant to this provision to the subcontractor.
