General Conditions <br />duties and responsibilities for the safety and protection of the Work shall continue until such time as <br />all the Work is completed and Owner has issued a notice to Contractor that Work is acceptable. <br />4.3.4 Contractor agrees to indemnify the Owner and their agents and employees against all claims, <br />demands, losses, damages and expenses (including attorneys' fees) arising out of or resulting from <br />the Contractor's violation of any safety law, regulation or code (including without limitation OST -IA) <br />or any other prudent precaution. <br />5. MEASUREMENT AND PAYMENT <br />5.1 REQUEST FOR PAYMENT <br />The Contractor may submit periodically, but not more than one each month unless otherwise <br />approved by the Owner, documentation summarizing work completed to date in the performance of <br />the Contract including measured quantities and associated unit prices in a tabulated format a <br />("Request for Payment") for Work done and materials delivered and stored on the site. Payment for <br />materials stored on the site will be conditioned on the following: <br />A. The Contractor shall submit evidence to establish the Owner's title to such materials. <br />13. Acceptable provisions have been made for storage. <br />C. The Contractor shall provide and maintain insurance against all loss, theft, vandalism, <br />damage and similar peril for the full value of the stored material. The insurance on the stored <br />material shall name the Owner as insured. <br />5.2 OWNER'S ACTION ON A REQUEST FOR PAYMENT <br />Within thirty (30) days of submission of any Request for Payment by the Contractor, the Owner <br />shall: <br />A. Pay the Request for Payment as submitted. The Owner may retain a percentage of payment <br />in the amount up to five (5) percent (hereinafter "Retainage") until final payment on the <br />Contract; or <br />B. Pay such other amount in accordance with Section 5.3 as the Owner shall decide is due the <br />Contractor, informing the Contractor in writing of the reason(s) for paying the modified <br />amount; or <br />C. Withhold payment in accordance with Section 5.3, informing the Contractor in writing of the <br />Owner's reasons for withholding it. <br />5.3 CONTRACTOR'S OBLIGATIONS '10 SUBCONTRACTORS <br />The Contractor shall pay any subcontractor within ten clays of the Contractor's receipt of payment <br />from the Owner for undisputed services provided by the subcontractor. The Contractor shall pay <br />interest of one and one-half (I-1/2%) percent per month or any part of a month to the subcontractor <br />on any undisputed amount not paid on time pursuant to this provision to the subcontractor.
