General Conditions
<br />shall not be construed to negate, abridge or otherwise reduce any other right or obligation of
<br />indemnity which would otherwise exist as to any party or person described in this Section. The
<br />Contractor, in addition to, and conformity with, all of the other requirements of this Section, will be
<br />required to indemnify the property owners from whom temporary construction easements were
<br />obtained and include said property owners as additional named insured on the appropriate insurance
<br />rider. Names of the property owners, along with other required information, will be provided to the
<br />successful bidder after the Contract has been awarded.
<br />4.2 PERMITS AND LICENSES
<br />All permits and licenses necessary for the prosecution of the Work shall be secured by the Contraotor
<br />prior to the commencement of the Worlc. Contractor shall also pay all public utility charges,
<br />governinental charges and inspection fees.
<br />4.3 LAWS REGULATIONS ANT) SAFETY
<br />4,3.1 Contractor shall give all notices and comply with all laws, ordinances, rules and regulations
<br />applicable to the Work. If Contractor observes that the Executive Overview, General. and Technical
<br />Provisions, Special Provisions, Drtiwings, and Equipment Lists are at variance therewith, it shall give
<br />Owner prompt written notice thereof, and any necessary changes shall be adjusted by an appropriate
<br />Change Order or other Modification. If Contractor performs any Work knowing or being in a
<br />position to know it to be contrary to suck laws, ordinances, rules and regulations, and without such
<br />notice to Owner, it shalt bear all costs arising therefrom; however, it shall not be its primary
<br />responsibility to make certain that the Executive Overview, General and Technical Provisions,
<br />Special Provisions, Drawings, and Equipment Lists arc in accordance with such laws, ordinances,
<br />rules and regulations.
<br />4.3.2 Contractor shall be responsible for initiating, maintaining and supervising all safety precautions
<br />and programs in connection with the Work, Contractor shall talce all necessary precautions for the
<br />safety of, and shall provide the necessary protection to prevent damage, injury or loss to:
<br />A. All employees on the Work and other persons who may be affected thereby;
<br />13. All the Work and all materials or equipment to be incorporated therein, whether in storage on
<br />or oft' the site; and
<br />C. Other property at the site,
<br />4.3.3 Contactor shall comply with all applicable laws, ordinances, rules, regulations and orders of
<br />any public body having jurisdiction for the safety of persons or property or to protect them from
<br />damage, injury or toss. The Contractor shall erect and maintain, as required by the conditions and
<br />progress of the Work, all necessary safeguards for its safety and protection. Contractor shall notify
<br />owners of adjacent utilities when prosecution of the Work may affect them. All damage, injury or
<br />loss to any property referred to in Section 4.3.2.6 and C caused, directly or indirectly, in whole or in
<br />part, by Contractor, any subcontractor or any directly or indirectly employed by any of them or
<br />anyone for whose acts any of them may be liable, shall be remedied by Contractor. Contractor's
