MINUTES <br />CITY COUNCIL <br />MARCH 25, 2015 <br />REQUEST <br />TO VACATE <br />A PORTION <br />OF ROSE <br />LANE — <br />SAM ROBERTO <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-3-58 — APPROVING AN ON -SALE <br />INTOXICATING RESTAURANT -EVENT CENTER LIQUOR <br />LICENSE AND A SUNDAY LIQUOR LICENSE FOR JJ'S <br />HOSPITAILITY, 2900 RICE STREET, SUBJECT TO SUBMITTAL <br />OF THE APPROPRIATE CERTIFICATE OF LIQUOR LIABILITY <br />INSURANCE WITHA LICENSE PERIOD EXTENDING THROUGH <br />JUNE 30, 2015 <br />The foregoing resolution was duly seconded by Fischer. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Sonnack reported that JJ's Hospitality withdraws their application for a 2 <br />A.M. Liquor License. <br />The City Administrator reported that Sam Roberto, 308 Savage Lane, has <br />submitted a petition to vacation the Rose Lane right-of-way. The <br />Administrator indicated that the petition does not comply with statutory <br />requirements, so it was not processed. He also noted that the petition does <br />not identify the specific portion of the street that Roberto would like to <br />have vacated. The Administrator indicated that the Council could call for <br />a public hearing to consider the vacation, and with a Council -initiated <br />vacation it would take a 4/5ths vote of the Council to approve. <br />The Administrator reviewed his report relative to some conflicts that have <br />existed between the Roberto property and the Anderson property <br />involving the Anderson's having the right to use Rose Lane as a private <br />driveway. The Administrator reported that permission was granted for <br />this driveway access when the house was approved for construction back <br />in the late 1970's. He noted that the unimproved Rose Lane right-of-way <br />has not been deemed open for public use, but can be used by the <br />Anderson's for their driveway access. He also noted that there has been a <br />history of code compliance issues raised by Mr. Roberto regarding the <br />Anderson property. To address this issue, a variance was granted in 2012. <br />However, some violations related to storage have apparently existed from <br />time -to -time since that variance was granted. <br />The Administrator noted that if the entire right-of-way were vacated, part <br />of the property would accrue to the homeowner of 2552 Savage Lane. <br />That property owner would then need to grant an easement to the <br />Anderson's to allow the driveway usage over their property given the <br />6 <br />
