that he or she is owner and head of household at his or her address and is receiving Retirement <br />Survivors Insurance or Disability Insurance under the Social Security Act, The applicant must <br />also verify that their annual household income is below the low income level established by the <br />U.S. Department of Housing and Urban Development. For the purpose of this subsection, a <br />senior citizen shall be a person sixty-five (65) years of age or older, the owner and head of a <br />household, and entitled to benefits under the Social Security Act, A disabled person is defined <br />as one who is sufficiently disabled as to qualify for Disability Insurance benefits under the <br />Social Security Act and is also the owner and head of his or her household. <br />205.150. PENALTIES AND ENFORCEMENT. <br />(A) Any person violating any provisions of this Code shall be guilty of a <br />misdemeanor and upon conviction thereof shall be punished by a fine as established by City <br />Council resolution or by imprisonment in the county jail for a period not to exceed ninety (90) <br />days, or by both. <br />(B) Whenever any building has not been connected to the municipal sanitary sewer <br />system as required in Section 205.020 hereof, the health Office= Building Official of the City <br />shall serve a written notice upon the owner or occupant to install plumbing and make such <br />connection as required by this Code within thirty (30) days after service of said notice, and if <br />the owner or occupant fails to install plumbing and make a sewer connection to the City sanitary <br />sewer system within thirty (30) days after such written notice is given and proof of such service <br />of notice has been filed with the City Administrator, the Council may by resolution direct that <br />sanitary plumbing and sewer connection be made and the cost of the installation shall be paid in <br />the first instance by the City out of the general fund of the City and the actual cost thereof shall <br />thereafter be assessed against the property benefited. After such installation and connection is <br />completed there shall be served a written notice of such assessment and an order directing the <br />owner of the property, or his representative, to pay the assessment within ten (10) days after <br />service of the written notice, to the City Treasurer, and after proof of such notice and order if <br />the assessments have not been paid within the ten (10) days, the same shall be certified to the <br />County Auditor for collection as other assessments for benefits, except that such assessments <br />may be spread over a term of three (3) years, if so requested when certified, and the said <br />assessment shall become a lien upon the property until paid. <br />205.160. RECITALS. The Metropolitan Waste Control Commission, a metropolitan <br />commission organized and existing under the laws of the State of Minnesota (the <br />"Commission"), in order to receive and retain grants in compliance with the Federal Water <br />Pollution Control Act Amendments of 1972 and regulations thereunder (the "Act"), has <br />determined to impose an industrial user sewer strength charge upon users of the Metropolitan <br />Disposal System (as defined in Minnesota Statutes, Section 473.121, Subdivision 24) to recover <br />operation and maintenance costs of treatment works attributable to the strength of the discharge <br />of industrial waste, such sewer strength charge being in addition to the charge based upon the <br />volume of discharge. In order for the City to pay such costs based upon strength of charges and <br />a formula for the computation thereof for all industrial users receiving waste treatment services <br />205-9 <br />
