MINUTES <br />CITY COUNCIL <br />APRIL 22, 2015 <br />indicated that he would like to fill and landscape the unimproved right-of- <br />way <br />ight-ofway cleaning it up and making it a part of his yard. Keis stated that he did <br />not see an issue with that provided that the Watershed reviews and <br />approves the filling so that drainage patterns are not impacted. <br />The City Administrator asked if Roberto would have the right to removed <br />trees on the right-of-way. The City Attorney indicated that he would like <br />to check the Law as well as check with the LMC. <br />The Administrator asked if Roberto planned to put a shed up on his <br />property or use the right-of-way access as a drive to his backyard. <br />Roberto indicated that he might want to put a shed up. He felt he should <br />be able to share the unimproved right-of-way. <br />The Administrator noted that Anderson has concerns with tree removal <br />and a lack of screening. The Administrator asked if Roberto and <br />Anderson were willing to sit down and try to come to a common ground <br />on the matter. The Administrator felt the situation was more of a <br />neighborhood dispute than an issue of public purpose. The Administrator <br />was hopeful that the issue could be moved forward with a win/win <br />solution for everyone involved. Fischer agreed indicating that the City <br />could get involved and the decision may be one that no one is happy with. <br />Fischer felt the issue was one of equity and indicated that he sees no <br />hardship in the matter. <br />Johnson asked if his property taxes would increase if the entire right-of- <br />way is vacated and half of the land accrued to his property. The City <br />Attorney did not think there would be a significant change in Johnson's <br />property taxes. Johnson stated that he was not comfortable with the <br />vacation given he would end up with a private easement across his <br />property. Johnson indicated that that would work out for him, but he was <br />considering the future and potential resale of his property. Anderson also <br />noted that there would be costs for him and Johnson for drawing up and <br />recording an easement in the event the right-of-way is vacated. <br />Johnson indicated that he was not in favor of the vacation of the entire <br />Rose Lane right-of-way. He also indicated that he did not feel moving the <br />Anderson driveway made much sense. Johnson stated that his preference <br />was that no trees be removed from the right-of-way. <br />In considering the information this evening, the Council's consensus was <br />that all the information should be gathered and a meeting should be held <br />by City staff with the impacted property owners to see if an agreement <br />could be reached. Montour indicated that he would be willing to <br />participate in the meeting as well. Montour suggested that Roberto put <br />together a landscape plan showing what he wants to do, including <br />identification of the trees that he would like to take down.
