MINUTES <br />CITY COUNCIL <br />SEPTEMBER 12, 2007 <br />asking that the City agree that it will not use eminent domain to acquire <br />the property, and that the City will not require building improvements as a <br />result of this inspection, such as installation of a fire suppression system. <br />However, if the School Districts undertakes building improvements that <br />triggered Code upgrades, these upgrades would still be required. <br />The City Administrator also noted that there will be the need for City <br />watermain upgrades in this area. The City Engineer is currently studying <br />the specific need. The Administrator reported that upgrades to the City's <br />water main system will also not trigger a requirement that 916 upgrade the <br />fire suppression system within the Capitol View building. <br />Blesener pointed out that when the County reconstructs Rice Sri•eet, <br />additional right-of--way may be required. The Administrator pointed out <br />that the County is not party to this agreement. He also noted that the City <br />has preserved its rights from a public purpose standpoint, as long as the <br />operation of the school is not impacted. <br />The City Administrator noted that the Capitol View property has been <br />identified as a potential redevelopment site, but the City has no plans to <br />aggressively pursue the property given the potential cost under eminent <br />domain factoring in relocation costs. The Administrator indicated that this <br />agreement gives the School District some assurance that the City does not <br />have an ulterior motive in asking for• an interior inspection of the building. <br />Mr•. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-9-226 -APPROVING THEAGREEMENT <br />REGARDING INTERIOR INSPECTION WITH THE NORTHEAST <br />METROPOLITAN INTERMEDIATE SCHOOL DISTRICT 916 <br />SUBJECT TO DISTRICT 916 PROVIDING THE CITY WITH <br />ACCESS TO THE BUILDING WITHIN THE NEXT FEW DAYS, <br />AND AUTHORIZING THE MAYOR AND CITYADMINISTRATOR <br />TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Blesener•. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />ST. JUDE The City Administrator reviewed in detail his report dated September 7, <br />TIF 2007 outlining the St. Jude TIF parameters. The first issue is the creation <br />PARAMETERS of TIF District 5-1 as a Renewal & Renovation District, which requires the <br />inspection of the properties included in the district to ensure that they meet <br />the standards necessary for this type of district. This issue has been <br />resolved with the Access Agreement for the Capitol View site. <br />
