MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2007 <br />more than 10% of the rear yard of a property. Anything above that <br />amount as well as trailers would have to be part of an Interim Use Permit <br />for outdoor storage. <br />Stanke noted that some properties do not have rear yards. The City <br />Planner indicated that in those cases a Variance could be processed with <br />the hardship being the unique configuration of the property. The Planner <br />noted that consideration would likely be given to allowing this parking <br />behind the front line of the building in the side yard. <br />Stanke raised the issue of a landscaper who has equipment on trailers. <br />These trailers are typically gone all day during summer months, but store <br />in the yard dm•ing winter months. The Planner noted that the City would <br />not be saying that trailers cannot be outdoor storage items, they will just <br />have to part of the Interim Use Permit. The Planner noted that at times it <br />is difficult to distinguish from a trailer being used and one that has junk <br />stored on it. Under the Interim Use Permit, the City would be able to <br />make this distinction as well as enforce the IUP. <br />The Planner then reviewed the proposed changes under the Conditional <br />Use section of the I-1 District. He noted that under Paragraph C, City staff <br />is recommending that the City Code coincide with State Statute and <br />require indoor display space for at least five vehicles. There was also <br />discussion on whether or not the State requires office space in conjunction <br />with this type of license. It was the consensus of the Council that a <br />general statement about meeting State Statute requirements should be <br />added. <br />The Planner noted addition of the language in D.3. requiring that vehicles <br />being displayed be licensed and in operable condition. D.4. limits the <br />number of vehicles that can be displayed outdoors for sale to a maximum <br />often. <br />It was suggested that C. include a general statement that vehicles stored <br />indoors will be stored in such a way as to comply with applicable fire <br />codes. <br />The Planner then reviewed the language proposed for E. 1. through 5. <br />under Conditional Uses. The Planner noted that E.3. states that there shall <br />be no open outdoor storage of parts for Major Auto Repair uses. <br />The Planner then reviewed the new section addressing Interim Uses, <br />specifically A.S. which requires that storage of material or equipment must <br />be capable of moving under its own power, is stored on a trailer, is stored <br />within weather-proof containers, or other storage arrangements as <br />
